The investigation is still active and ongoing. It's still possible that Baldwin and others will be charged. If it's true that he didn't actually pull the trigger, then I'm sure that makes things much more complicated when determining which charges can be filed and against whom.
He is 100% guilty of killing an innocent woman. He pulled the damn trigger.
