It is infuriating... and intellectually dishonest.... but factually true. And serves the average person's understanding of the general principles involved. For example, the County isn't accusing anyone of anything so there's no need to provide evidence of anything. The lawsuit does accuse others of misconduct, therefore demanding evidence of misconduct.

Unfortunately, too many people think the government has "rights" -- the same rights as persons -- and that the people do not have the right to transparency in the conduct of our business.

The article deftly focuses the reader's attention on the outcome rather than the process. The lawsuit itself provides the evidence for the misconduct, but no one knows if/to what extent the misconduct affected the outcome.

Mostly people are ignorant on fine points, and lazy readers -- if they even bother to read beyond the headline. "Journalists " know this.

But, as Kari has stated, if the election process is illegitimate then the election outcome is as well.

Regarding Secretaries of State not recusing themselves when they are candidates in the election-- it's been a problem for a while, in several states.

There is a difference though...

Georgia doesn't have a State Law requiring them to recuse. If Arizona does, then Katie Hobbs refusal is a criminal act. Kemp's wasn't (not that I'm ok with his refusal either)...

Arizona does not have a specific law mandating recusal, but does have specific laws pertaining to conflicts of interest.(Thanks to JinMI who found those statutes)

So it's not necessarily against the law, and is not a matter for criminal courts (yet), it is very much against our sense of fairness and ethics, and definitely a matter for the court of public opinion... and therefore the state legislators responsible for election laws.

Especially when an election is being loudly and widely contested, and the Governor-Select uses her power and authority as sitting Secretary of State to threaten and persecute dissenters....

Oh, my bad, I thought there was one.

The bottom line though, is, neither the SoS or anyone else should not have the Power or Authority to affect the outcome of an election even if they wanted to.

Yes.

And now that we know it's a reality, and a problem, the state legislators need to fix this. It shouldn't even be a partisan issue.

So.

What will happen should the judge throw it out?

I assume she would try to appeal.... or perhaps re-file in a federal court... or she gives up and doesn't do anything.

I can't think of any other options.

The more days that pass without a judge throwing out Kari's lawsuit the better. Every one of the 2020 election-related lawsuits that were rejected, were thrown out in under 3 days. Something like 51 of them!

DOMINION VOTING SYSTEMS FYI

Summary of Forensic Audit of Dominion Voting Machines, ordered by a Michigan Judge:

We conclude that the Dominion Voting System is intentionally and purposefully designed with inherent errors to create systemic fraud and influence election results.

The system intentionally generates an enormously high number of ballot errors. The electronic ballots are then transferred for adjudication. The intentional errors lead to bulk adjudication of ballots with no oversight, no transparency, and no audit trail. This leads to voter or election fraud.

Based on our study, we conclude that The Dominion Voting System should not be used in Michigan. We further conclude that the results of Antrim County should not have been certified.

WHICH LED TO the Biden Administration issuing an urgent Bulletin regarding Dominion Voting Software Security Weaknesses.

But the 2020 election was "the most secure ever", according to the same Federal Government that was working with Twitter and Facebook to ensure Joe Biden beat President Trump on November 3, 2020!

From FACTCHECK

Audit in Michigan County Refutes Dominion Conspiracy Theory

Full Story
A Dec. 17 audit of ballots cast in Antrim County, Michigan, affirmed the outcome of the presidential election there — refuting viral claims that the election software used by the county, and elsewhere, had facilitated massive fraud.

The audit, conducted by state and local officials and representatives of both political parties, involved a hand tally of all the votes cast for president in the county. The findings verified the county’s outcome, in which President Donald Trump beat President-elect Joe Biden by nearly 3,800 votes. (Biden ultimately beat Trump in the state by more than 154,000 votes.)

In a county with more than 15,700 votes cast for president, the audit showed a gain of 11 votes for Trump and a loss of one vote for Biden. Small variances are expected in a machine versus hand count.

The audit came days after the release of a report purporting that Dominion Voting Systems software used in Antrim County was “intentionally and purposefully designed with inherent errors to create systemic fraud and influence election results.”

Though state officials disputed the report as lacking credibility, its claims traveled far on social media. www.factcheck.org...

From you link

The Cybersecurity and Infrastructure Security Agency (CISA) has notified election officials of software vulnerabilities found in Dominion Voting Systems equipment deployed in several states, but also that the agency has found no evidence that those vulnerabilities have ever been exploited.

The nation’s cyber defense agency said there is no evidence that the vulnerabilities have affected any election results, including the 2020 presidential election.

“We are working closely with election officials to help them address these vulnerabilities and ensure the continued security and resilience of U.S. election infrastructure,” Brandon Wales, CISA’s executive director, said in a statement to MeriTalk.
