Bridges for Media Freedom, an organisation which has been monitoring the hearings, said Mr Assange's barrister, Edward Fitzgerald QC, told the court his client did not appear by video link because he was unwell.

The regulations covering the use of the Armed Forces during civil disturbances do not go quite that far, but they do assert two constitutionally based exceptions— sudden emergencies and protection of federal property.
