As defence are pleading for mistrial they can use Tommy's video and discussion of this on UK messageboards in evidence and gain acquittal as presumption of innocence was voided. At 5pm on Friday the defence issued a plea bargain which will be heard on Tuesday, due to Tommy committing the alleged offense on a Friday and national holiday on Monday, granting them three days to get a claim together instead of one.

The actions will likely be declared to have caused irrecoverable damage to the case and cause a mistrial as the publication and content of his broadcasting would influence the sentencing. Hopefully that can be avoided but the rules of this are very strict.

Even if prosecuted they can appeal for acquittal as it fits all 'sensational, inaccurate and misleading' criteria that was precedent in 1991 Taylor sister case - when the Sun printed a headline saying "killer" mistress, with an arrow connecting the word "killer" to one of the sisters faces, this tiny act was enough to overturn conviction for murder.

He already has had an unfair trial. He was sentenced to 13 months in prison in less than an hour. He was denied his own attorney.
