Mueller, I think.
who referred the case to the ny feds?
They followed Mueller's recommendation, yes. Apparently Mueller had reason to suspect Cohen of criminal activity. Apparently there was sufficient probable cause for a warrant to be issued and materials gathered.
they did what they were told
I don't know if that's a factual statement. Upon what do you base it?
criminal activity NOT arising from muellers investigation or he COULD NOT refer it to ny
Maybe. Maybe not. I don't know. Is there something which prevents him from making such a referral if it also falls within the scope of his investigation?
so this referal is outside his scope
For items in which Cohen was acting as Trump's attorney, yes.
and trumps priviledge stands
Unless there is evidence which implicates Trump in those "random crimes." Maybe there is, maybe there isn't.
random cohen crime does not invalidate trumps privilege

It doesnt exactly work that way. The government has to have evidence of a crime (IE probable cause) to obtain a warrant. You cant just sift thru documents in hopes of finding evidence of a crime. Search warrants have to be specific and the bar gets higher when its a lawyer.
Trumps privilege stands. That is reinforced by the fact Trump is not involved with what is going on with Cohen. Since Trump is not involved his documents are protected since they have no bearing on the case against Cohen.
Mueller and Rosenstein stated Trump has nothing to do / no link to Cohens case.
