If he wasn't officially a client there is no attorney-client privilege. Being billed is irrelevant to the matter, a free consultation is still privileged. Hannity is making the claim that he was just asking general legal questions, not questions related to his legal situation.

Correct. Silly raised the prospect of pro bono and I said maybe Cohen thought he was doing pro obno for Hannity. Either way Hannity has nothing to do with the criminal investigation into Cohen with the exception of Cohen falsely claiming Hannity was a client. I can see a judge wanting a formal response from Hannity should Cohen face charges for lying to the court.

Doesn't mean the material wasn't on the warrant only that they want to claim attorney client privilege on some of it. I'm pretty sure everything about the warrant was to the letter and air tight. This is the biggest case probably in history and you think Mueller is suddenly going to get careless?

It does matter if an item is not on the warrant. You run into fruit of the poisonous tree issues.

Honestly it looks more like a defensive strategy in an effort to have all documents seized classified as privileged (attorney-client).

Mueller has nothing to do with this Cohen issue/. He referred it to the SDNY to deal with which is why it is highly doubtful its has any relation to Trump. If it did it would have remained in Muellers realm. Plus Mueller recently stated his probe will be wrapped up by next month since they will not be interviewing Trump.

Yes the bar is high to get a warrant for files from an attorney. This was just round 1 - an attempt to block the action with the privilege argument. The next argument, imo, will be the fact they seized items not on the warrants. While technically a 4th amendment violation there are some exceptions that exist that allows evidence to be seized without a warrant if there is a risk of the evidence being destroyed before a warrant is obtained and on scene.

However in those instances the evidence can only be seized but cannot be processed until the warrant is obtained.

Seizing everything, including items outside the warrant, and then sorting through to see what is relevant and what is not is highly unusual. Warrants are specific and restrictive for a reason.

Its like asking for a warrant to search a room in a house and turning around and searching the entire house. A warrant also restricts law enforcement to searching areas that can fit the items being sought. If your looking for a stand alone safe that is 5 feet high, 3 feet deep and 3 feet wide you cant search areas that could not contain that size of an item.

He performed legal work for Hannity.. Hannity is his Client and Cohen is a Lawyer....um for most folks that would make them their lawyer. Apparently Hannity has special rules that apply only to him? Do tell.

Comeys opinion was that he was running everything like a mob boss too. Muellers investigation has been proceeding the same way they do to take down mafia figures.

Several rumors have come out over the years that Trump was involved with the mafia and that he structures his organizations like the mob.

It's likely an apt description.
