Among the guidance the HHS announced:
— It is requiring insurers to accept payments until Dec. 31 for coverage starting on Jan. 1. It is also “urging” insurers to give individuals more time beyond that to pay for coverage. In other words, if somebody pays for coverage in the middle of January, HHS is asking insurers to retroactively make that person’s coverage effective as of Jan. 1. HHS is also asking insurers to cover individuals who offer a “down payment,” even if that payment only covers part of the first month’s premiums.
— In a press release, HHS said it was also “strongly encouraging insurers to treat out-of-network providers as in-network to ensure continuity of care for acute episodes or if the provider was listed in their plan’s provider directory as of the date of an enrollee’s enrollment.”
— HHS is also “strongly encouraging insurers to refill prescriptions covered under previous plans during January.”
On a conference call, an HHS spokeswoman emphasized: “We are just proposing it as an option and we’re encouraging issuers. There is no requirement.”

Under the the Federal Information Security Management Act (FISMA), the Department of Health and Human Services’ Center for Medicare and Medicaid Services (CMS) is required to have an “Authority to Operate,” or ATO. In order to receive an ATO, new information tech systems must perform a set of tests, including “Security Control Assessments” (SCA).
But according to CMS’s 2014 budget request, no such security assessment took place. The Federal Healthcare Marketplace website was rolled out without full end-to-end testing.
Indeed, the large number of new systems created because of Obamacare created a backlog of testing. CMS could not complete its required security. Failing to complete the required means no ATO, and hence a violation of federal law under FISMA.

I was watching a Senate hearing that occurred today on one of the C-SPAN channels. Senator Issa directed the hearing with 3 "specializing" doctors.
One of the Senators was from Oklahoma. He said that there were 1400 small businesses in just Oklahoma City that have receives insurance cancellations. One business he mentioned was a small car dealership with 14 employees.
Remember the 5,900,000 "people" who have received cancellations? I really believe that to be "policies". I also believe that the average number of "people" per "policy" will be Greater-Than-ONE ... SO, who knows how many people have actually lost their health coverage AND how many of these are already in an active-treatment process?
Those doctors weren't sure that they would be able to refer patients to other doctors because of the patients "in" or "out" of network status and/or if the "referred" doctor was "in" or "out" of network OR the doctor would be listed in any "network".
One doctor said that the Obamacare "guidelines" would prevent him in some cases to not be able to prescribe the most-appropriate drug to the patients ... (the "guidelines" force a specific-sequence of prescriptions).
These "interviews" should have been more significantly nationally televised. The word "death panel" did come up on two occasions BUT Senator Issa instructed everyone to NOT use that description.
One of the "specialized" doctors issued a warning using the term ... "T Minus 20 Days and Counting" ... (referring to the number of days remaining until 2014)

When loved-ones start dying due to these heavy handed ObamaCare changes, we'll start hearing news stories about relatives attacking the government offices that make and enforce ObamaCare. The government murders people all the time, but never this overtly.
