The President of the United States has available certain powers that may be exercised in the event that the nation is threatened by crisis, exigency, or emergency circumstances (other than natural disasters, war, or near-war situations). Such powers may be stated explicitly or implied by the Constitution, assumed by the Chief Executive to be permissible constitutionally, or inferred from or specified by statute.Through legislation, congress has made a great many delegations of authority in this regard over the past 200 years.
A state of emergency is a governmental declaration that may suspend some normal functions of the executive, legislative, and judicial powers; alert citizens to change their normal behaviors; or order government agencies to implement emergency preparedness plans.
At least two constitutional rights are subject to revocation during a state of emergency: The right of habeas corpus, under Article 1, Section 9 and the right to a grand jury for members of the National Guard when in actual service, under the Fifth Amendment.
The Insurrection Act of 1807 is the set of laws that govern the U.S. president's ability to deploy troops within the United States to put down lawlessness, insurrection, and rebellion. The National Emergencies Act set a limit of two years on emergency declarations unless the president explicitly extends them, and requires the president to specify in advance which legal provisions will be invoked.
The activities of significant transnational criminal organizations continue to pose an unusual and extraordinary threat to the national security, foreign policy, and economy of the United States. For this reason, the national emergency declared in Executive Order 13581 of July 24, 2011, and the measures adopted on that date to deal with that emergency, must continue in effect beyond July 24, 2013. Therefore, in accordance with section 202(d) of the National Emergencies Act (50 U.S.C. 1622(d)), I am continuing for 1 year the national emergency with respect to transnational criminal organizations declared in Executive Order 13581.
Move over executive orders. President Obama has another tool to push policy absent congressional stamp — and it’s far less known and controversial. It’s called executive action.
The beauty of the action is that it avoids Republican criticisms and conservative charges that Mr. Obama acts like a “monarch” when issuing executive orders, The Hill reports. So while on paper, Mr. Obama may actually appear as if he’s issuing fewer executive orders than many other presidents who have served two terms, the reality is he’s still finding plenty of ways to bypass Congress. He’s just not calling those ways executive orders.
Mr. Obama has disdained the executive order label for “executive actions,” Mr. Mayer said. And he’s used that action to push his own policy on a variety of issues, from gun control to immigration to overseas drone strikes, The Hill reports

Well how about "trying" a rebuttal? So then you think it is appropriate for him to sidestep congress? What's your opinion on executive actions? What's your opinion on him openly proclaiming that he will get around congress on his own?
