Richardson Hearing



A Richardson hearing is a hearing to conduct an inquiry into the surrounding facts and circumstances of an alleged discovery violation. For example, a Richardson hearing might be requested because the opposing party attempts to call a witness not included on their witness list. The court will attempt to determine whether discovery violations are inadvertent or willful, trivial or substantial, or affected the defendant's ability to properly prepare for his\her case. The question of prejudice does not depend on whether the undisclosed evidence might have affected the outcome of the trial, but whether the violation affected the defendant's ability to prepare.

I'm that's how and opinion is formed. Trial and error of similar situations. The longer you do something the more you learn and sometimes you might learn something new you didn't know prior.

The M.E. has basically said he changes his mind all the time. He has not only changed his mind on how long Martin was alive but also about the effects on Martin that the *can't be named drug on ATS* had on him. The M.E. also says he can't remember anything ... not even what was discussed at meetings yesterday ... without notes.

If you were watching this trial instead of trolling the thread, you would know that witnesses testified that he did holster his weapon as he said in police interviews, the reenactment, etc etc. So much for your "research" huh?

You been on this thread bragging about how all you need is your hands, and weapons are for the weak... yet the first thing you did was go inside and some chucks? Is that not a weapon?
I didn't grab a gun...with intentions to kill. I'm not going to be intimidated either. I can scare someone, just as easily. I'm surprised George didn't FLASH his weapon, attached to his hip. This way, Trayvon would have thought differently. Makes you wonder why he didn't reveal his firearm, as a scare tactic. Why didn't he lift up his jacket and reveal his piece?

I would think the jury is confused with him as well. I don't think the ME help explain anything worth a darn as far as guilt or innocence. IMHO

Judge still refuses to allow toxicology about *certain drug not to be named at ATS* in Martins system. She based that on past information and not on the fact that this M.E. has changed his mind again and now says that it may have had an effect on Martin.

BTW .. this M.E. says he can change his mind every hour ....
(that's a direct quote from him)

Judge rules for the prosecution to keep toxicology out .. even after the ME says he changed his mind.

That has already been answered for you in this same thread by multiple people. It is illegal to flash a gun at someone. That would make him the threatening figure. He shouldn't have to flash a gun to keep a guy from jumping him (the guy should just not be a criminal and not assault him).

Judge still will not let the jury hear anything about TM's toxicology report. Even though the ME has changed his mind on what the THC levels could have caused in TM.

#1. You would be the world's biggest idiot if you "flashed" your firearm. You are taught NOT to do this in any firearm class. If you "flash" your firearm, you better be pulling the trigger.

#2. Flashing your firearm and using it as a scare tactic is illegal.


#3 It does not matter if you did not grab a gun. Your whole point was how you were so tough you don't need any weapons, only your fist. That is what you said, then go on to tell a story about running to get a weapon. I got some news for you, you can kill with chucks just as you can with a gun. You debunk yourself

GM didn't grab a gun he carried a gun on his person, he had a cc permit. it is well know that you never flash your gun.

It's pretty infuriating isn't it? I wonder if she isn't keeping tally on how many breaks she has given the prosecution (and how many times she has screwed over the defense). In my opinion she should be fired, but there are a lot of crooked judges. This is a multiple mistrial imho.

The talking head legal eagles at the news site I'm watching say that the judge just handed the defense an easy 'retrial' if Zimmerman is found guilty.


Once again the M.E. is saying that he doesn't remember anything.
And he just said he has no idea if the body was handled correctly or not.

Wow, Wonderboi, just wow....

I am out of patience, will one of my fellow gun owners who have taken a fire arms safety course have a quick talk with our idealistic young friend so we don't have to worry about one of our own ATS kids dying due to gun negligence?

Zimmermans blood wasn't found under Martins finger nails, but this ME can't tell anyone how long the fingernails were or anything about it. He has no idea if they were long enough to get scrapings or not. He repeats .. I HAVE NO OPINION and NO MEMORY.

I agree, with everything that has gone on, there will easily be a retrial if GZ found guilty.
This ME just keeps saying he didn't do this and didn't do that. He doesn't even know the protocol for the scraping under the fingernails. You would think that a ME would know all of the protocols for anything and everything that happens inside of the autopsy room.
