Even though the Second Amendment has been brought up before at length, I thought I would share this story. With Government edging closer to tyrannical lunacy, its a matter of time before the average American questions ( if they haven't already) the full implications of how BIG our Government is, and what our current leaders are doing to curtail the freedoms we still have today. We are looking into the face of Tyranny our founders warned about..........

No controls on guns, school security or other changes will deter a deranged murderer. Good Samaritans toting guns can minimize the carnage; reason enough for an armed populace, but the Second Amendment doesn’t pertain to self-defense, hunting or sport shooting. We have an obvious right – nay duty – to defend our families and neighbors, which are covered under the catchalls of the Ninth and Tenth Amendments, but the Second Amendment concerns resistance to federal hegemony.

Disarmament is the necessary precursor to tyranny. History’s most lethal mass murderers have been dictators presiding over unarmed subjects. Stalin, Hitler, Mao, Pol Pot never faced significant civilian resistance. Oh that the Jews had been better armed. The Warsaw uprising began with one small pistol.

The 2nd Amendment Is What Makes The Other Nine Possible

We hold these truths to be self-evident, that all men are created equal, that they are endowed by their Creator with certain unalienable rights, that among these are life, liberty and the pursuit of happiness. That to secure these rights, governments are instituted among men, deriving their just powers from the consent of the governed. That whenever any form of government becomes destructive to these ends, it is the right of the people to alter or to abolish it, and to institute new government, laying its foundation on such principles and organizing its powers in such form, as to them shall seem most likely to effect their safety and happiness..

DECLARATION OF INDEPENDENCE


A key, and important word is unalienable.


The constitution expressly declares, that the right of acquiring, possessing, and protecting property is natural, inherent, and unalienable.



The United States is a Country founded on Principles and Beliefs. From our Declaration, to the Bill of rights,our founders strove to make a better World for free people.They also knew that Governments can become, and have become tyrannical, and put measures in the Constitution, that we call Amendments. The Second Amendment is one of those.

A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed.....



Why would they put this in? Why the Second Amendment?

The original intent and purpose of the Second Amendment was to preserve and guarantee, not grant, the pre-existing right of individuals to keep and bear arms. Although the amendment emphasizes the need for a militia, membership in any militia, let alone a well-regulated one, was not intended to serve as a prerequisite for exercising the right to keep arms.

It is clear that these "rights" cannot be taken away.

Our founding Fathers knew this, and acted accordingly to put this in, as our Second Amendment.

St. George Tucker a lawyer, Revolutionary War militia officer, legal scholar, and later a U.S. District Court judge (appointed by James Madison in 1813), wrote of the Second Amendment:


The right of the people to keep and bear arms shall not be infringed, and this without any qualification as to their condition or degree, as is the case in the British government.

In the appendix to the Commentaries, Tucker elaborates further:

This may be considered as the true palladium of liberty... The right of self-defense is the first law of nature; in most governments it has been the study of rulers to confine this right within the narrowest limits possible. Whenever standing armies are kept up, and the right of the people to keep and bear arms is, under any color or pretext whatsoever, prohibited, liberty, if not already annihilated, is on the brink of destruction. In England, the people have been disarmed, generally, under the specious pretext of preserving the game: a never failing lure to bring over the landed aristocracy to support any measure, under that mask, though calculated for very different purposes. True it is, their bill of rights seems at first view to counteract this policy: but the right of bearing arms is confined to protestants, and the words suitable to their condition and degree, have been interpreted to authorise the prohibition of keeping a gun or other engine for the destruction of game, to any farmer, or inferior tradesman, or other person not qualified to kill game. So that not one man in five hundred can keep a gun in his house without being subject to a penalty.

There are many other sources that show what our Founding Fathers thoughts were on the Second Amendment. For those who believe that this Amendment is archaic, and serves NO purpose, I leave you these quotes from men who either didn't have such Amendments, or Constitutions, or usurped them.

[49] The law was apparently aimed at the warlords who were contesting the central government's authority; Chinese peasants were far too poor to afford guns. Shortly after the Nazis took power, they began house-to-house searches to discover firearms in the homes of suspected opponents. They claimed to find large numbers of weapons in the hands of subversives. [31] How many weapons the Nazis actually recovered may never be known. But as historian William Sheridan Allen pointed out in his study of the Nazi rise to power in one town: "Whether or not all the weapon discoveries reported in the local press were authentic is unimportant. The newspapers reported whatever they were told by the police, and what people believed was what was more important than what was true." [32] Four days after Hitler's triumphant Anschluss of Austria in March 1938, the Nazis finally enacted their own firearms laws. Additional controls were layered on the 1928 Weimar law: Persons under eighteen were forbidden to buy firearms or ammunition; a special permit was introduced for handguns; Jews were barred from businesses involving firearms; Nazi officials were exempted from the firearms permit system; silencers were outlawed; twenty-two caliber cartridges with hollow points were banned; and firearms which could fold or break down "beyond the common limits of hunting and sporting activities" became illegal. Oh ok... now, I read through your OP and the provided links and I'm unable to see how the other nine amendments are made possible by the 2nd...??

Are you suggesting that without the 2nd, the other nine wouldn't be possible??

Can you address the other nine amendments and qualify how they have been made possible by the 2nd amendment according to the title??

I have some more questions for you OP...

The OP is saying that the reason we still have the other 9 rights, is due to the the 2nd one, because with out it, what you have is a unarmed population, but an armed government who may, or may not listen to it's people.

A good example of it working would be what happened in Athens, TN back in 1946, known as The Battle Of Athens.

This is a good case of when peaceful measures to enact change in your government does not work due to tyranny. The will of the people was being ignored, and it did not mater how they voted, because the elections were being rigged to favor those that were in power.

After several complaints to the Department Of Justice, which went ignored, the locals had had enough:

Polls for the county election opened August 1, 1946. About 200 armed deputies turned out to patrol the precincts—the normal complement of 15 deputies significantly augmented by reinforcements from other counties.

A number of conflicts arose before the polls closed, the most serious of which was when deputy CM Wise shot and wounded a black man who was trying to vote.[3]

As the polls closed, deputies seized ballot boxes and took them to the jail. Opposition veterans responded by arming themselves and marching there. Some of them had raided the National Guard Armory, obtaining arms and ammunition.[5]

Estimates of the number of veterans besieging the jail vary from several hundred[5] to as high as 2,000.[3] When the men reached the jail, it was barricaded and manned by 55 deputies. The veterans demanded the ballot boxes but were refused. They then opened fire on the jail, initiating a battle that lasted several hours by some accounts,[3][5] considerably less by others.[6]

In the end, the door of the jail was dynamited and breached. The barricaded deputies—some with injuries—surrendered, and the ballot boxes were recovered. During the fight at the jail, rioting had broken out in Athens, mainly targeting police cars.[3][5] This continued even after the ballot boxes were recovered, but subsided by morning

The recovered ballots certified the election of the five GI Non-Partisan League candidates.[6] Among the reforms instituted was a change in the method of payment and a $5,000 salary cap for officials. In the initial momentum of victory, gambling houses in collusion with the Cantrell regime were raided and their operations demolished. Deputies of the prior administration resigned and were replaced.

The good news is that the battle had no fatalities (but some very scared, corrupt LEOs, finally understanding that the citizens were pissed and had had enough).

My personal favorite amendment, besides the 2nd, is the Tenth Amemendment :

The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.

Since I'm a big fan of State's Rights.

The 2nd Amendment is no longer a right, it is a privilege granted by the government. Didn't you see the news conference yesterday???

Everyone gets checked out first by the government to see if they fit to the governments criteria, then and only then are they allowed to purchase a limited type of firearm with a specific load capacity and type.

Unfortunately, you are right though. The word "executive" has become the new way of bypassing congress, and the provisions we had in place, to make decisions in this country.
In 4 more years, it will be a new President, doing this, if Tyranny doesn't destroy this once proud Country by then.

Well certain states are working around that. It's called the Firearm Freedom Act. The link will show you a map of state by state, and the status of their bills on this.

Basically, the bills say that due to the 2nd, 9th and 10th amendments of the constitution, and by the right of their own state constitution, that the federal government can not dictate to residents of that state about firearms, as long as the firearm was manufactured and purchased in that state.

Important emphasis on that last sentence, due to SCOTUS rulings on the 10th amendment. The federal government can dictate on a firearm that was manufactured say in NY and you live in Montana, and you bought it.

Here is a list of the states that have already passed this bill into law:

Utah
South Dakota
Tennessee

My own state, South Carolina has entertained this bill be for back in 2009, but have reintroduced it this year. The bill is quite clear:

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING ARTICLE 9 TO CHAPTER 31, TITLE 23, TO ENACT THE "SOUTH CAROLINA FIREARMS FREEDOM ACT", TO PROVIDE THAT A FIREARM, FIREARM ACCESSORY, OR AMMUNITION MANUFACTURED AND RETAINED IN SOUTH CAROLINA IS EXEMPT FROM FEDERAL REGULATION UNDER THE COMMERCE CLAUSE OF THE CONSTITUTION OF THE UNITED STATES.

I respectfully disagree Sonny. Everything in the Bill of Rights works together, here's my perspective on how each protects the 2nd.

Treading on the 1st limits your right to speak about the 2nd.

Treading on the 3rd enables soldiers to enter your home for quarter, what's to stop them from taking your arms while under your roof?

Treading on the 4th enables LE or military to enter your home without probable cause (think gun grab).

Treading on the 5th denies you the right to stand before a jury and plead your case of legal gun ownership.

Treading on the 6th, same as the 5th.

Treading on the 7th makes you vulnerable to being held accountable by civil lawsuit should your gun be stolen and used to cause harm.

Treading on the 8th same thing only think exorbitant bail.

Treading on the 9th makes you vulnerable to the tyranny of the majority, ie if the majority accept the current progression regarding gun rights.

Treading on the 10th allows the federal government to over rule States rights, say Texas refuses to conform to any regulation set by the fed, erosion of the 10th makes them a chihuahua barking at a rottweiler.

Each of the First Ten are critical to each other.

We can't only speak up when our favorite is threatened.

My favorite is the 10th Amendment.



Without the Second though, you have an unarmed populous, free for the taking. In my world, actions will always speak louder then words. Tyranny and usurping ANY of these Amendments starts with the citizens losing their rights to bear arms. Its easier when you are not armed.

Did they use free speech? did they use the right of legal representation (lawyer)?

They used firearms to secure all remaining freedoms that they
had been petitioning and talking about for years.

And it was only about 3-5% of the population that did the fighting as well.

It’s funny how on every gun thread the first response is always someone ready to jump in swinging. I’ll never understand why guns in the hands of your neighbors is so terrifying. After all, that’s the way its always been in America and the violent crime rate has been steadily going DOWN for decades!

We got all of our rights through the use of guns! We maintain all of our rights through the possession of guns. Look at the actions of Stalin, Mao, Hitler, Pol Pot, Assad, Castro, Chavez, etc. They first disarmed the people they sought to oppress. Any people can be oppressed when they are stripped of their means of defense. This is really very simple, friend.

History is what this thread should be about. I think MANY have forgotten that the British went looking for weapons to confiscate from their "citizens"..........
