I kinda think they should get rid of that judge myself. He is a disgrace to the system.

If he thinks like that then maybe the legal system should be examining his past. Where do we get these kind of people from? Who the hell would put him into that position.

You see, when rape is occurring, unless the woman is a hussy and simply asking for it, the lady parts seal up in order to prevent the attacker's member from intruding. It's a natural defense mechanism God installed in every woman.

That was sarcasm up there, in case you didn't catch it.

I seriously doubt your wife, daughter, sister or mother would think it was very funny.

Are you sure this judge isn't a close relation to U.S. representative Todd Akin? It could be a genetic thing where the ignorant gene was passed on to him.

I just don't see the humor in this, I REALLY don't.

I find it deeply deeply disturbing that a man so obviously un-educated about even the simplest of understandings about how the human works managed to get into such a position of authority. In my mind there is no grey area here, he has proven that he is not of a fit state to hold his position and as such should be dis-barred (does that apply to judges or only lawyers?) and never allowed to step into a courtroom ever again. It might be a bit of an over-reaction but I'd also be inclined to put him through a very thorough psych evaluation as well considering how warped his image of women is.

This.

Anybody that holds a law liscense in any given state can be dis-barred for mis-conduct amoung "other things".

I believe he can be recalled; but this is a longshot at best based on the recent election.

Seriously, look who they just put back in the White House.

Exactly! and I am not even a woman, this is just insane what he said! He should be stripped of his titles!
And thrown into prison.

This is awful and this man does not deserve to be judge. This woman needs justice.

Apparently he was reviewed and is still a Judge because he issued an apology. Is it really an apology if nobody's hitting him in the face?

(Disclaimer: Although I feel he deserves it I have no intention of hitting him in the face.)

You are an insult, not the judge. The judge, is correct ...

You want to judge everyone, accused of rape ... based on your sole feelings of "sympathy" for the victim. In your mind, the "accused" must prove his innocense.

Actually what the judge stated was an insult to all victims of rape and/or sexual assault, and no the judge is NOT correct, and my response has nothing to do with feelings of sympathy for the victim.

The judge stated as fact something that has no basis in fact what so ever and in fact is so incredibly ignorant (meaning completely uneducated) regarding the workings of the female body one is left wondering how someone so lacking knowledge or education regarding sex and the female anatomy could maintain his status as a judge for 12 years.

The judge's statement which is an insult and completely unfounded was as follows :

I spent my last year and half in the D.A.'s office in the sexual assault unit. I know something about sexual assault ... I've seen women who have been ravaged and savaged whose vagina was shredded by the rape. I'm not a gynecologist, but I can tell you something. If someone doesn't want to have sexual intercourse, the body shuts down. The body will not permit that to happen unless a lot of damage in inflicted, and we heard nothing about that in this case ... That tells me that the victim in this case, although she wasn't necessarily willing, she didn't put up a fight.

Statement copied from

I copied from here because the official statement is a pdf and the statement can only be copied as an image. To read the entire statement one can find it here:

Decision and Order Imposing Public Admonishment

The public is supposed to be able to have confidence and trust in the impartiality of the judiciary, A judge who states with such certainty something that is so entirely, outrageously, and were it not for the gravity of the case laughably, erroneous, then goes on to firmly state that he is granting the defendant a lesser sentence based on his false belief, undermines the confidence and trust the public is entitled to regarding the impartiality of the judiciary.

This case also raises questions regarding how many other cases regarding rape or sexually assault he used this reasoning on, and upon finding no shredded vagina, determined that the crime did not occur and allowed a potentially dangerous sex offender go free to harm others

This geezer needs to be transported to a loony bin asap.

off site quote I took from another post:

He saw what??? Since when do legal people have to look at 'shredded vagina's'? One padded room please!

What are you a Todd Aiken supporter?
I'm sorry if my jested post rained on your parade. Considering your expressed disapproval of Obama, it seems like I hit a nerve because Aiken is a republican. If you didn't find any humor in my post, move on. Why even respond?

You vote for one of the available applicants, chosen by the system we have. This has nothing to do with Obama voters, it has to do with the people choosing the candidate. Usually candidates are chosen by their social status in society, this means our upper social class is irrational.

It has everything to do with Obozo and your party.

I can count the number of people who research judges in your district on one hand.

They vote straight party line 99.5% of the time.

Who are you trying to fool. High society my ass.

Having been raped, and assaulted - I find this story disgusting. I've already shared my views on rape in a recent thread and have no desire to share them again. This judge, should be dismissed or penalized for the comment. A woman has no control of her body when under attack. Yes, rape is an attack. All she needs to do is say "No" or "Stop". That's fighting enough.

Listen, this 'judge' has severe issues and why they haven't canned him is beyond me. I can only imagine how horrible the rape and the aftermath must have been for you.

I think we need a screening system for people like these.

Poisonous minds like these shouldn't have positions of power, because they think they can bring us back to their "glory days" of the 1950s, which wasn't as clean and squeaky as it was portrayed in Leave It To Beaver.

Rape is rape, nothing justified or legitimate about it, so why do these people insist on down playing it. He should attend a rape counselling meeting once and see what it actually does.

Well, the judge's name is Johnson, and this guy is obviously a dick
. What an idiot.
Yes, he should be disbarred, and have his prior decisions reviewed for evidence of bias. Not only is his chain of "logic" outdated, this does smack of the type of thinking that a rapist would use.
If people in other occupations made this kind of statement, or displayed this level of insensitivity, they would be fired, and this jerk should be too.

I live in OC...I'll dig a bit and see what I can find in the local media about this arsewipe.

I have no party, The polarizing they are teaching us did not work on me. It is crazy for someone to vote strict Republican or Democrat in the first place, you vote for the best candidate. There are bad candidates in both parties. It seems that people vote for candidates that are popular with the elite sects of society who are interested in gaining power for their kind. We need to change this policy and get rational people in charge. Trouble is who in their right mind would want a job trying to run this country. Maybe that's the problem, we vote crazy people into office because sane ones don't run

To me this judge sounds very insensitive and I feel kind of disgusted by his remarks and an insult to the victims rape.

he should know the difference between 'wanted' sex and 'forcible' sex. The one is done with consent while the other is done with force or threat of violence.

I think this case should be revised and this guy should get a higher sentence as this judge clearly wasn't in his right state of mind

"... very insensitive ..."

More like "very ignorant"; but then I'm guessing he's a fundamentalist, believes in the rapture and carries a huge leather bound bible from which he quotes to those beneath his stature in life....
