Antonin Scalia: SCOTUS Immigration logic "boggles the mind"

Scalia wrote the dissenting opinion on the SCOTUS immigration decision.

news.yahoo.com...

But to say, as the Court does, that Arizona contradicts federal law by enforcing applications of the Immigration Act that the President declines to enforce boggles the mind."

Arizona bears the brunt of the country's illegal immigration problem. Its citizens feel themselves under siege by large numbers of illegal immigrants who invade their property, strain their social services, and even place their lives in jeopardy. Federal officials have been unable to remedy the problem, and indeed have recently shown that they are unwilling to do so. Thousands of Arizona's estimated 400,000 illegal immigrants—including not just children but men and women under 30—are now assured immunity from enforcement, and will be able to compete openly with Arizona citizens for employment.

So question:

Why doesn't the 2nd Amendment come into play? The States have a right to a "well-regulated" militia. Non-citizens crossing the border into Arizona are not only violating Federal law, but the Executive branch has deliberately chosen not to do it's duty to protect the borders.

At what point does a state have a right to protect it's borders if in fact the Federal government chooses not to?

who knew that the checks and balances included the executive branch's ability to "choose not to enforce" the laws put in place by the legislative branch? I bet the founding fathers didn't and I can guarantee that the Obama administration thinks they have skirted the law and public opinion. Sadly the Bush administration set the precedence, so who the hell knows?

What's even more interesting is that Obama declared after the SCOTUS ruling that he's ordering DHS NOT to respond when Arizona officials arrest an illegal immigrant unless that person is wanted for a felony.

Anybody under 30 can now walk across the Arizona/Mexico border unimpeded.

No they can't, that's delusional. As is saying Obama has done nothing to enforce immigration laws when deportation numbers are the highest they have ever been. And please don't bother "accusing" me of supporting or loving Obama. I no longer do, I can't stand him he's way too far Right bordering on Fascist.

Okay this is just a pet-peave of mine but the correct acronym for our Supreme Court is USSC, not SCOTUS. Try searching some case law on Lexisone or any other legal reference search engine and you will see it is USSC, as in USSC 410 U.S. 113 Roe v. Wade. It isnt even called the Supreme Court of the United States, it is the United States Supreme Court.

As far as your comment that Obama is so far Right that he is almost fascist, well that gave me a real laugh. Even members of his own party think he is too far to the left and too liberal. I really hope this was an attempt at humor, if not you really need to read up on the meaning of Left and Right and the history of the Democans and Republicrats starting with the Federalists and Antifederalists during the drafting of our constitution to understand what is left and what is right.

USSC only shot down some of the more absurd portions of the bill. Like police being able to detain and question you if you nod at vehicles in home improvement parking lots lol. Police can still investigate immigration status in the commission of a crime, and can still detain for said reasons.

That aside.. if the Governor really wanted to start shooting people at the border I just don't see that going good in any form. In fact.. that'd be quite a SHTF scenario.

Show me such. Who on the imaginary left is calling Obama too far left? I'm quite correct on the meanings, perhaps you aren't?

obama too liberal for liberals-CNN
There's one source for you, there are plenty more sources to be found just look for them. Obama thinks that socialist ideals are good and serve the public good, that is the polar opposite and antithesis of the ideals of the Right. However niether the left or the right are truly interested in the good of the country or citizens, they are two sides of the same coin, each self serving to government and corrupt to the core.

It has nothing to do with me thinking, or trying to be smarter than anyone, its just using the correct term. Your link to the United States Sentencing Commission proves nothing. Above Top Secret is known as ATS but do a search for ATS.com on the web and A&T Systems is the result you get, so does that mean that ATS isn't the correct acronym for Above Top Secret?

Hey whats the topic again ?
Oh ya, Arizona cant protect its boarders because ##SNIPPED## says so.

I thought that Arizona is allowed to ask people for "papers" if they are stopped ? Everything else got thrown out by the supreme court ? In any case what ever the supreme court says, Arizona will do whats best for itself. They are not going to wait for the ##SNIPPED## train to come and help them.

You know what, why don't we just round up all the #ing immigrants and march them to gas chambers? Would that make the gun nuts in Arizona happy? How about the whiners that refuse to see the problem for what it really is, taking out all of their anger on the immigrants themselves?

It's become clear to me that none of the immigration opponents have a leg to stand on at this point. You refuse to go after those who create the demand for cheap labor. You refuse to look at the human side of this conflict. Hell, some of you won't be there to apply for the jobs that immigrants leave behind.

And for the love of god, LOOK AT THE FACTS! Deportations are UP, not DOWN. What part of Obama's crackdown on immigration do you not get?

Yes, the AZ is allowed to ask for papers, then notify the Feds.

Immediately after the decision Obama announced that the Feds simply will ignore AZ when they arrest somebody unless the person is already wanted for a felony.

This, along with arming the Mexican drug cartels, is direct violation of the oath of office to defend the Constitution and protect the country from all enemies.

Crackdown? Obama just announced he's not going to enforce existing Federal law, not is he going to cooperate with AZ if they arrest illegals who are not wanted for felonies.

I'm sure nobody in AZ wants to march illegals to the gas chamber, just back to Mexico where they came from.

I believe AZ is going to begin doing just that and they will use their 2nd Amendment right to have a well-regulated militia to justify arresting and throwing out of their state illegals. They can just dump them across the boarder in California and it wouldn't violate anybody's "rights."

Illegal immigrants do not have a "right" to be here. The case in front of the Supreme court was brought by Obama against AZ for violating the rights of the Executive branch to NOT enforce immigration laws.

1009 people participated in that poll and that is supposed to mean something in a country of 350 million? The answers they gave are none too surprising with political media itself wrongly defining Liberalism as Left and wrongly defining Obama as a Liberal. Take a good look at his record and tell me again how he is a Socialist? Tell me how his policies haven't directly been in favor of "Capitalism" over the People.

The topic of illegal immigration is beyond ignorant illegals break the law to get here, and then "some fine folks" decided to use the rule of law to defend the breaking of the law.

Get that?

Use the rule of law to defend the breaking of the rule of law.

That is some failed logic,.

Exactly.

The AZ law was unconstitutional. That's why most of it was struck down even by a conservative-leaning supreme court.

I swear, for all the "constitution-thumping" the right does, you sure seem willing to throw it straight out the window as soon as brown people are involved.
