This is what I was thinking. It reminds me of how some people hide pornography in torrent files or on usenet. The person downloading wants to get music, or a movie, or even something entirely legal through a torrent service, and little do they know, it has child porn buried in the files.
Who do you think would get arrested in this scenario?

You're ignoring a lot of variables in this scenario. It's not "unrealistic". The reality is the original owner of the phone no longer had access to their phone. Gone. Whatever happens to it after that is out of his or her control. It doesn't necessarily have to be the supposed "thief" that puts the content on the phone.edit on 8-2-2012 by SyphonX because: (no reason given)

Chips, Buddy... There was child porn on the phone.
Magistrate Michelle Hodgson said the man needed to be congratulated after his actions led to a 46-year-old man being charged with child pornography offences.
The thief was charged for his crimes and the phone owner, for theirs.
Quick, take back the nelson laugh before anyone notices!
Yeah, ' nonces' are considered the scum of the earth in prison, even more so that murderers, that fact really makes you realise how abhorrant paedophilia is.
Theres a point of law (if thats the right word) that annoys me though, it when people stick up for the online paedophile by saying he (or she) having actually interfered with a child, theyve just watched it, well, if it wasnt for these scumbags theyd be no market for it.
I cannot find any sympathy for someone who considers a child a sexual object, and i am the most liberal and forgiving person you couljd imagine.
That said, I am not surprised in a way... I mean, even people in prison consider pedophiles the lowest of the low.edit on 7-2-2012 by gimme_some_truth because: (no reason given)

I completely agree. Yeah, I have seen people before standing up for the creeps ( Keep in mind T&C keeps me from calling them what I want) who just watch child porn. In my mind there is no standing up for them.
As you say, if it weren't for them, there would be no one to market that filth to. If it weren't for them, maybe there would not be some loser who decides to film himself raping a child in order to sell it to other pedophiles.
If it weren't for them, perhaps the amount of children harmed would be quite a bit smaller.
Yes, child rape would still happen..But it is a disgusting fact that there is an entire underground market for children and child porn. Children who are kidnapped and sold into sexual slavery so that this crap can continue to exist. Child porn really does have victims...It also opens the door for more victims....
I have no sympathy for pedophiles either. No sympathy for anyone that can hurt a woman or child, in any way.
So I do agree completely with you.
Yeah, even prisoners have a moral code. People who hurt children are at the bottom of the barrel. Worthless garbage. And this is murderers who feel this way! That should really tell you something.
Anyway, I am going to bow out of this thread. I've really said all I can say, so there is no sense in me rambling on any further.

No, you are ignoring common sense. It IS unrealistic. The reality is that the child porn was on the phone before it was stolen. This is why the thief FOUND it on the phone. The owner was charged with possession of child porn for a reason.
Is it possible for you to lose your phone and some one finds it, puts child porn on it and turns them selves in as a thief in order to pull a prank? Sure... But it would be stupid and unrealistic.
Would YOU put yourself in jail for theft just to mess with some ones phone and inconvenience the owner that you don't even know? See? It makes no sense to do. It is unrealistic.
Thief steals phone. Thief finds owners child porn. Thief turns himself in, in order to report pedophile and get him off the streets. That's what happened and that is what is realistic.
Your variables go against the story and the charges. This is not a scenario, the facts have been laid out for us. So these variables you are trying to throw in, really don't fit.edit on 8-2-2012 by gimme_some_truth because: (no reason given)

Unrealistic? The more brilliant it is. The "thief" could have been just some scumbag that was paid off to frame that guy. It's a possibility.
IMO it's illegal evidence and should be ignored.
