Federal court blocks Oklahoma ban on Sharia law

OKLAHOMA CITY – An amendment that would ban Oklahoma courts from considering international or Islamic law discriminates against religions and a Muslim community leader has the right to challenge its constitutionality, a federal appeals court said Tuesday. The court in Denver upheld U.S. District Judge Vicki Miles-LaGrange's order blocking implementation of the amendment shortly after it was approved by 70 percent of Oklahoma voters in November 2010. This really disturbs me , that we can no longer govern the American people by the US Laws and Regulations...

Granted our system is flawed....

But since when do we allow people from another religion allow their "religious law" trump our own system, of checks and balances?

How does this not violate the "Seperation of church and state" That liberals scream about?

Are we to assume now, that , in this area of the country anyway, If a muslim commits a crime that is "justified" by muslim law, that he is exempt from the law of the land?


What are the ramifications of this?

How did we as a people in the US allow something like this to happen.......

Im fully against this, as I believe if you come to this country you abide by the laws we have in place.....

This is a mockery of justice.

I agreee that it is a sham and a damned shame that the will of the people can be over-ruled by political correctness.

Separation of church and state only appear to exist when it's christian churches.

I agree, the will of the people spoke, and it was over ridden..........this is ridiculous.....

Now......in our own country, we have people implementing their religious laws , that they use in countries that are RULED by them, on our own soil......

We were warned about this.......but no one would listen...........now watch as it takes hold

I know many people who went to catholic schools and they were indoctrinated and fed propoganda every day . Why would a moslem school be any better?

He can claim to be christian all he wants, but early brainwashing stays with you for a lifetime.

Well i don't know enough about Sharia law to be able to understand the impact this would have, but sorry, this line says it all:

"When the law that voters wish to enact is likely unconstitutional, their interests do not outweigh Mr. Awad's in having his constitutional rights protected," the court said.

Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof ....

It, loosely, fits under that as this bill wasn't targeted only at Sharia law, but apparently specifically mentioned it several times, which is why they are trying to block it.

Anyways, what would this actually mean (they said they have no record of ever applying Sharia law)? Would this only affect Muslims, what exact impact would this have on the legal system?

Keep in mind, this isn't saying they would be enforcing Sharia law on YOU. And this possibly unconstitutional bill isn't just about Sharia law.

Exactly, and I would find it hard to believe that any US laws would be trumped by Sharia law, it merely sounds like they want to protect their right to have Sharia law and international law considered to those who wish it be applied.

honestly, i can see both sides of this, how people would be alarmed by this and also how passing a bill like that would be unconstitutional.

This judge made a good decision. Such a law does discriminate against one particular religion, and that is clearly not in accordance with the US Constitution... that whole pesky First Ammendment, that states there will be no state religion in the US. To discriminate against one particular religion is a step in the direction of establishing a state religion... or so it can certainly be argued.

Also, if one steps back from the hysteria a moment, the quote in the OP clearly states that this law is blocked from implementation until the constitutionality of the law has been challenged and decided.

This is a good decision.

My question as well, and I'd find it hard to believe Sharia law would trump US law, it sounds more to me like them attempting to reserve the right to consider it.

Take for example, some states where a judge can decide, instead of the person going to jail, they can make reparations to the victim. The law states, you commit the crime, you do the time, but other things are allowed to be considered.

That's how I see this, allowing Sharia law to be considered, but US law obviously still applies.

Well then get your affairs in order, under Sharia law if you refuse to be a moslem you are to be beheaded.

I would love to know what scary ass propoganda machine you are plugged into that gets you so worked up over what appears to be a ton of ignorance about what Sharia is or the legal rammifications of not banning it.

There is currently no ban on Sharia law.
There is currently no ban on Abrahamic law.
There is currently no ban on Halacha (Jewish Law)
In the United States.

Reasons why only not banning one of those is supposed to upset me?

If you are punished under a law under Sharia and not under American law, are you libel for your actions if it took place in America?

There are laws in place here that are pretty clear cut, plus the ban only says they can petition.
