Man 'dies', revived, drives, arrested, jailed

A disqualified driver who got behind the wheel just hours after he was released from hospital following a drug overdose will spend four months behind bars after he was sentenced in an Australian court.

According to his lawyer, Jim Allen, Benjamin Matthew Kennedy, 24, "died" and was revived after being hospitalised and the distress that caused him contributed to his decision to drive his car in Wagga Wagga, New South Wales.

Allen told the court Kennedy's state of mind should be considered a mitigating factor while giving submissions on sentence.

had to post this for the title alone!

Went through a few different emotions reading this....
First he overdosed on drugs and he dies...naaw....then is revived.. yay! Then drives on a disqualified license... Boo! and goes to jail after going through all that..naaw...

Some people get all the luck...

He shouldnt be going to jail and i dont know why it stood up in court because he could easily claim that he was still under influence of drugs or prematurely released.. A whole number of legitimate exscuses and precidents.
Think about if an old person or child just got released and done something stupid, most would say its not their fault.
But talk about bad luck!!!

ed: in all seriousness, I know people who OD'ed and lived, and from perscription stuff before you get all righteous on me. jail is a bad idea, like the plot in the film AI was a bad idea.

Oh I'm sure you're right.. the idea of jailing the man seems excessive.. and ludicrous to be honest.

How could he possibly be in anything resembling his right mind at the time?

And what kind of lawyer can't win that case?

And what kind of judge does not take these things into account. Apparently leniency is a foreign word to his mind?

How about let's just do away with oppressive government and then we won't have to bother with the specifics and heart-wrenching debates over all this mess?

Oh wait, I forgot. Everyone is so irresponsible and immature they need a Mommy and Daddy Govt there to hold their hands and spank them when they are bad. Pathetic.

Yet another non-violent victimless "crime" and "criminal offender" severely punished. Good job justice system! Keep up the work of putting non-violent people who've caused no harm behind bars where they belong. The lawyer no doubt never mentioned that the person never actually did any harm and there was no victim.

People should have a RIGHT to drive unless they are driving recklessly, without any sort of drivers license.

It wouldn't be victimless if he killed another person in a wreck because he was driving impaired. A few months in the slammer will help dry him out and is hardly severe punishment. Please don't go on about how this poor addict can't help himself and needs all sorts of help. He needs a spine transplant and some personal responsibility for his actions. He should have been sentenced to hard labor and been forced to reimburse the hospital for the medical manpower required to save him.

I don't think anyone is prepared to live on their own. Without the boxes (anything law) some people would break without deminson and regulation. The laws like a home give comfort.. to the sheep.

When this guy woke up this morning in jail I am willing to bet he had no clue what has happened in the last 24. Thats really too bad
