Family sues police over California Taser death

Kephart was driving in Rimforest, 60 miles northeast of Los Angeles, in May when he honked at a patrol vehicle that turned in front of him, according to the lawsuit filed on Tuesday in San Bernardino Superior Court.

The sheriff's deputy then circled his patrol car back behind Kephart's vehicle and pulled him over at a nearby gas station, the lawsuit said.

The three officers used their electroshock Taser weapons on Kephart "without provocation or justification" for about 10 minutes, expending five cartridges, the lawsuit states.

Three officers and five cartridges that means a minimum of two reloads. One should not even need to deplete one taser cartridge to bring a perp down. The perp in question here was guilty of honking at a cop that cut him off.


He honked.


They pulled him over.

They tasered him into submission and even reloaded at a minimum of two times ensuring the victim would die by painful electrocution.

More then one cartridge was used. In fact FIVE cartridges were used.

Overkill If I ever saw it.

That is insane I wonder how the debunkers are going to try to justify this action. Even if the guy got testy 1 should have done the trick. If one can kill a person what did they think 3 where going to do o wait they knew what they where doing.

But they only make "mistakes" remember? You can't really expect all of that "training" to actually be put to good use now can you? I mean after all..You are a dangerous member of the general public and could have a weapon thus potentially harming an "officer of the law". To "Punish & Enslave" is the new motto..Learn it well.

all three officers should be charged with murder. How do cops get away with crimes that normal people would get life for? Forget suing for money, I want them in prison where anyone else would be if they tasered someone to death.

I completely agree. How did all three of them fail? Not one guy said to the other "Maybe we shouldn't reload our tasers. Maybe he has had enough lets call the meat bus."

How did this happen?


More importantly , why haven't they been brought up on criminal charges? A lawsuit will not get these, these, these, murders off the street!!!! To relaod a taser and continue firing!!!!! That is worse then anything!!!

needed to pick my jaw up off the floor. I had not heard his before. This is absolutely crazy. I almost honked at a cop who was sped through a stop sign yesterday. Couldn't see him, trees were in the way. He sped out of no where, without lights or sirens. Unbelievable. To think cops will go to this extent with their power trips is shocking. It's numbing.

And suing means nothing, in circumstances such as these. Law enforcement uses our taxes to defend themselves in court, and our taxes to pay any damages incurred in a lawsuit. Life. In. Jail. Without the possibility to parole. Let the gangs go to work on them, and see how that turns out.

Disgusting. When stuff like this happens, the chief of police should be on every news station assuring the public something like this will never happen again, he's changing the culture in his district, he will put those three behind bars for the rest of their lives, so they can't do any harm to others(same thing he'd say if it were three of us who did it), as well as on his knees, begging for an apology. Disgusting.

I can only suspect that the reason they choose to sue over pressing criminal charges must be that the DA is involved in protecting the murder cops.

So did anyone bother to do any further reading? Or did you just swallow what was spoon fed to you and then instantly react to it without using any form of thinking?

I looked up the guys name, and all I can find is information about him running a stop sign, and then fleeing from police, and resisting. So do you know the truth?

Do you really believe he got pulled over and tasered because he honked is horn? Or maybe he did flee from the police and resisted arrest and the cops used their tasers because they didn't know what to expect?

The OP's article is making statements from the lawsuit, not statements of what actually happened.

Oh wait. You now get 75 years in jail for audio taping the police, but they sure as hell can do it (amid other things like murder as well) to you.

So, where's the police cruiser video showing these "honorable" officers doing their duty?

I would like to add that running a stop sign, fleeing from police and resiting are also not offenses that require one to unload 5 tazer cartridges. Unless this man was the hulk?

I'm with a lot of the other people here. Regardless of this guy's perceived transgressions. It should only take one cartridge to disable a man and put him under arrest. Five is just ridiculous.

Reliance on the JustUs system for justice is an exercise in futility. Killing a member of my family in such a manner would be ample reason to seek justice elsewhere.

Stories like this have me wondering when, if ever, the family member of someone murdered by cops will decide to get a little justice, now that their life is up on blocks and all but ruined.

Or maybe that's already happened?

There isn't anyone who would murder someone close to me that should ever be sleeping with both eyes shut again. I wouldn't care who they were.
