i dont think this is right at all, good for the owner for taking it to a jurt trial... get the laws changed in that area. there's a thing called jury nullification... would work wonders in this case.

True! But if you have one of those restrictive HOA's, good luck. They can change rules at any point, and literally force you to do whatever they feel is the 'common good'.
