No, no, there's no similarity at all.
This is the idea that you can use those spontaneously appearing particles as carriers for an electric current. Since they are quasi-existent, they may offer no losses due to resistance.
That is completely different from "energy from nothing."
And, no - you do not have to demonstrate that a patent works to the patent office to receive a patent. All a patent does is protect the process you use from being duplicated and sold by someone else. There are patents for "spandex-like suits that improve physical performance and stop bullets" - I kid , you, not.

Those particles are themselves being used for current - That's electricity. The op didn't say " the particles form and then they can be used to carry current that we then add to them". The particles and the current are one and the same.
It is really the same thing. Listen to enough lectures given by Bearden and you will see how I can say that.
Before they grant you a patent you first submit an application. Next it is examined by one or more examiners to check the science behind the idea. You have to show them if not a working model a diagram or schematic of the device so they can examine it. If they do not think it's a sound principle, they do not grant you the patent.

What's funny about that is that is exactly what Tom Bearden has been saying for years. His patented free energy machine called the MEG is based on this principle. He had to prove to the U.S. patent office that his machine does in fact work for them to grant him a patent.
Funny how many people claim Tom is a fraud yet he has a patented machine and is backed up by scientists like Maxim Chernodub.
