I do honestly believe it...I don't know it...but I believe it. The SCOTUS loves the commerce clause...they won't do anything to weaken it, IMO.

I wouldn't make a bet with you on anything...I know your posting history...I'd say you are less than honest...just my opinion.


And IF...a BIG IF...the supreme court ruled it unconstitutional...it would only be for the mandate...not the whole bill. So then we are left with insurance companies required to cover pre-existing conditions and people not having to get insurance until they are sick. The insurance company will collapse...and then the government would be forced to take over anyway...and we would likely get a single payer system.

Either way...I don't care...it will all work out in the end. The mandate will either stick and eventually we will get a public option...or it won't and eventually we will get single payer. Win/Win.

No state court has the legal autourity to usurp the Federal Govt and that is that. 10 is null and void here.

If there was a proposal before either a court or The Congress to mandate that American jobs stay stateside the idiots would try and cite the 10th to get out of it.

The Federal Govt in this case needed to get involved in healthcare as for decades it has been a joke.

The "Death Panels" everyone was harking on as of late is your insurace provider on the phone 1,000 miles away dictating wether or not you qualify for this or that. Reality is that every insurance company has kills more Americans every single year then 9/11, Korea, Vietnam, Katrina, Iraq, Afghanistan combined.

This made it illegal if you or your kid got sick that they wouldn't get dropped. Stop doing the trillion dollar a year lobbying groups work and start doing the work that is for the people.

- Obamacare forces people to buy a product. It's unconstititional.

- This product is different than the mandated car insurance in that a person doesn't HAVE to buy a car, but if they decide to do so then they have to get car insurance.

- Obamacare waivers ... last count was to over 200 business' and organizations (NEA, McDonalds, etc). Waivers for special groups (some big democratic lobbiests and donors) ... That isn't exactly following the spirit of Obamacare, now is it?

- Obamacare is unsustainable. That's the bottom line. Healthcare reform is needed, but what has been presented is simply unsustainable .. especially if people are allowed to 'opt out' or get waivers. The system won't hold up.

Oh it is quite simple...the fact that you make it a point to say that you are against both the right and the left...that you are against both democrats and republicans....and yet all you are is a big cheerleader for the right and the republicans.

It's a common tactic used...it's called being a shill...but it is very easy to spot once you have seen it enough.

I consider that being less than honest. Like I said...just my opinion...seems to have struck a nerve tho.

I am pro freedom, and neither the D's or the R's platform is something I like.

There have already been other judges that have rule in favor of the Health Care Reform Bill. And other courts that have just flat out thrown out the cases challenging them.

Obamacare completely flies in the face of the Constitution. No way will it ever be found to be within the powers of government.

I will take a screencap and keep it in my media upload area as proof. No new accounts, nothing. The loser simply disappears from ATS for good.


Agreed. I have read up on the constitutionality of the mandate, various opinions of legal scholars as I am sure you have.

Scalia, Thomas, Alito, Roberts will look to overturn it..

Kennedy, Ginsburg, Breyer, Sotomayer and Kagen will rule it constitutional.

You can screencap that call as well just for fun
Though I wouldn't bet membership on the justice breakdown.

FYI - I'd be fine with a repeal of the mandate...as a repeal of the mandate would require a Public Option to have any reform work...gop or dem. and I strongly prefer the public option.

I am against abortion, support gay marriage, but don't mind Jesus or any other religious symbol in public...but I don't run around claiming I'm against both the left and the right and then only bash one side.

Would you care to post your resume`? Have you been vetted? Were you born in the USA? Do you believe in the Consitution as written by the founding fathers? Will you repeal "healthscare". Will you end the Fed? Will you prosecute those that have attempted to subvert our Nation? Are you a "regular guy"? IE Opposite of obama (Barry Soetoro) Kenyan by birth, communist by the NWO plan.

If your answer is "yes" to all these questions, then you just scored your first vote.

They tried to get the Public Option and the Insurance Exchange established but was defeated by the GOP and thier Insurance company lobbyists group masters and made sure it never got passed so that blame lies solely and squarely at tthe feet of the GOP and no one else.
