McCain argued the same thing as the Obama campaign did concerning their lawsuits.
Though McCain and his co-defendant, the Republican National Committee ("RNC"), vigorously dispute this claim, they argue that this court cannot decide it in any event due to a number of jurisdictional defects: lack of standing and ripeness, mootness, and nonjusticiability.
It was dismissed by lack of standing, exactly like all the other lawsuits contesting Obama’s eligibility.
For the foregoing reasons, the defendants' motion to dismiss is granted on the ground that Hollander lacks standing. All other pending motions are denied as moot.
It wasn’t McCain that produced the birth certificate, it was Hollander who annexed the birth certificate to his brief.
