Court rejects appeal over Redskins trademark

Washington (CNN) -- The Washington Redskins (3-6) are struggling this season, but the organization got a break Monday after the U.S. Supreme Court rejected an appeal from Native Americans calling the pro club's trademark "disparaging."

At issue was whether plaintiffs were decades too late in filing a lawsuit, or whether that registered trademark should have been denied years ago since as plaintiffs claim " 'redskins' is today and has been historically a disparaging racial epithet that brings them into contempt, ridicule, and disrepute."

I heard about this yesterday and figured that it may be worthy of discussion here.

How can the term "Redskin" not be racist? Better question is how the supreme court could rule that it is not racist. This is no different than using the "N word" among the many racial slurs.


The justices without comment refused to intervene in the dispute, effectively ending the suit.


w/o comment...WTF? I guess the supreme court (even with the inclusion of Sonia Sotomayor) is still too old and white to make the correct call here.

Don't like the Redskins, but I thought their fight song was in order.

I am from Louisana and love the New Orleans Saints. Maybe someone should file a lawsuit against the Saints name. After all couldn't this name be offensive to them?

I find it kinda dumb to sue over some politically correct bs.
The Washington Redskins haven't called anyone a racial name.
To me its politically correct garbage and just trying to stick up for your supposed offended culture...which nobody is trying to offend.

Its like not being able to say Merry Christmas because it offends people.
I agree with the judge...they have to deal with it.
The Washington Redskins organization hasn't called anybody racial epitats...its just a name.

I guess I can sue the Vancouver Canucks for offending me as a Canadian by not using the right word for Canadian.

Its just more politcal correctness in a world where we don't need it.

If people are that worked up over it then they clearly have too much time on their hands.

Just my 2 cents.

The Redskins have played in 5 Superbowls and won 3 of them. If that is considered a curse, 80% of the teams in the NFL would love to be cursed. They last won the Superbowl in 1992, since you have "always said" that would make you less than 17 years old????

Their curse isn't the logo. In fact, their 1991 team was the best I've ever seen. No, if you want to know why the Redskins suck, look at who has been writing the checks for the last decade. That's why they suck.

As for the logo itself, is it racist? I don't think it is. Is it politically incorrect? Probably, but I really couldn't care less about political correctness.

These people have been complaining about this since I was a kid. Some people are very thin skinned.

I'm a Redskins fan. Been ever since I was a kid.

How would the Cowboys/Redskins rivalry games be as fun if they have to change their name? Just wouldn't be the same.

There is a big difference between Mariner and redskin. You are just insensitive...it's a racial slur...kinda like having a team named the Atlanta Ni**ers. I am Native American, and it matters to me

I'm black but people seem to like to call me African American, I wasn't born in Africa and my parents parents were not. I would much prefer to be called black( or even darkie) than African American as it is a more true statement.

I would prefer that they go by the name of a local tribe...not by the slur. In your situation, there is no slur about "black" or "African American" regardless of your preference. Redskin is not a "ethnicity" choice on a job application. See what I mean? perhaps not...but it's still a racial slur...like it or not...perhaps I should have thicker skin...but I shouldn't have to...It's degrading...and that is all that matters.

No one..let me repeat...no one goes around and calls native's redskins and expects to get a rise out of them. It's not like they are the Washington Ingins or Washington Scalpers...or whatever. I have never, ever heard Redskin as a derogatory term until I heard about cases like these. It's just ridiculous. plain and simple.

Maybe it's because you are not a Native American. You probably didn't have any in your school growing up, so it stands to reason that you wouldn't hear of it until...but the slur is real, it cuts like a hot knife and it's offensive...

maybe I should throw around some racial slurs and see what people of other ethnicity think, alas, I have tact...something the US govt. and (apparently) no one on ATS has.

plus my brother's dad is half native, huge redskins fan.

Indeed it does...blacks even use the word N*I*G*G*E*R* (it's sad that I had to circumvent the system for that word, but not R*E*D*S*K*I*N) in their lyrics...but, even now, the more sensible of that ethnic community cry out for a stop to the use of the word...it's sad that those in YOUR community laugh it off...invasion and genocide must have slipped their simple minds
