The Obama economic plan now makes perfect sense!

Who now could afford one of these bumper stickers?

Going once, twice, any bids, any bids at all...well then next up is this pair of lovely genuine imitation diamond earings...do I have any bids...any? Going once, twice, any bids, any bids at all...well then next up is this lovely quart of fresh milk do I hear 5,000 dollars, 10,000 dollars, sold to the gentleman for 15,000 dollars, the security gaurd will escort you home!

What he is dealing with at this point are the unfortunate consequences for upholding his right.

This.

The First Amendment guarantees you the right to free speech: IE you cannot go to jail, get fined, etc., for saying something that's not a direct incitation to murder or some other crime.

It does not mean that you can tick people off without facing any consequences.

That said, I think trying to close down a store because they sell a bumper sticker you don't like is more than a little bit silly.

I wonder if the guy sold impeach Bush stickers when Bush was the President? I would say most likely as they were all over. BTW I don't agree with the sticker's sentiment.

Only one mall in my area is listed, but I avoid malls like the plague anyway, so this boycott will be no problem for me.

The mall's actions might not be unconstitutional, but they were sure gutless.

Obama is not a "black man".

Obama is a mulatto, the offspring of a black parent and a white parent.

But instead of using that as a force for unity, whites and blacks both use Obama's "ethnicity" to divide us.

Obama can't play the "race card". He is as white as he is black.

My business partner is a mulatto, this is one of his pet peeves with Obama's representation in the media.

Spivack has a right to free speech just as everyone else. However, a private corporate entity, such as a mall in this case, has a right to management. They are not in anyway encroaching upon his First Amendment rights, they're simply not allowing him to peddle his wares upon their property. He is free to open up shop in another venue and continue his business.

You may not like it, but the corporation is well within their rights to do so.

I don't think that legally they are allowed to tell him he can't sell his stuff there. He should have some kind of license to sell whatever his store carries and as long as the product he sells are not illegal then he can sell them. He should have a lease agreement and that agreement has terms in it and as long as he follows the terms he should be fine, he goes to court and wins this one.

If ever mall in America is going to exercises who and what is allowed to be sold in their properties very soon we will be inundated with places for white or black only, women or men only and only religious or atheist only.

That's to the extreme but one example of what we are heading is very obvious with this man been targeted.

That is why businesses or place of business can not discriminate on the basis of gender, religion and political views.

He actually have a case on violation of rights under the law.

Well now they have said they are NOT going to renew this man's lease. This is political discrimination and a violation of free speech.

I say that since a right wing, conservatives can not sell such wares in a kiosk in a mall, or anywhere else for that matter, then the democratic, left wing should not be selling theirs in mall kiosks as well. Either let both sides sell merchandise or no sides sell merchandise. Fair is fair. Remove them all. Period. Oh, but that would be an offense to the current administration that bans anything that doesn't not follow their agenda.

I will no longer shop at a mall that is managed by Simon Property Management Group. There is not one around here, but I have shopped that Concord Mills Mall in Charlotte many times. I'll not go there again, and when I travel and shop, I will check to see if it is a Simon property. I will also not spend another dime in our local malls that are selling the left wing, liberal, Obama merchandise. There are plenty of other places to shop.

So a local mall has the right to put up a sign that says, "No Conservatives/Liberals/Other Party" allowed?

I do not think so, that is political discrimination. If this is legal, well the law needs to change!

Political discrimination?!? Hardly.

Now, if he was asked to remove his conservative bumper stickers, then you might have a point. But they didn't. He was asked to vacate the premises, instead. There is no breach of the First Amendment.

Agreed that his first amendment right are not being violated, but Maria, you know as well as I that the man's political views are what landed him outside the "premesis". This is a clear-cut case of political discrimination.

What he ought to be doing is organizing a city-wide boycott on the mall based on the fact that the mall manager or owner doesn't appreciate the diversity of political opinion.

Or is that only the ideal thing to do when it's a Democrat being discriminated against?

As far as I'm aware, there is no such thing as political discrimination as far as U.S. law goes. It is apparent that many people are upset as they deem this to be an infringement of this man's First Amendment rights, which is obviously not the case.

That said, it was indeed an insanely stupid move for this private entity (mall owners) to not renew this man's kiosk lease. They are well within their rights to do so, regardless of the obvious negative fallout they are now receiving for their actions.

However, it should be noted that this is kind of conduct is played out on both sides of the political aisle, and is a sad result of the polarization of America. I personally know of conservative businessmen who blatantly refuse to do business with those they feel have a liberal bent. Is it petty behavior? Yes, but so what. It's their right.

The bottom line is this, if you don't agree with the actions of this mall owner, don't patronize their establishments. Power to the people.

While I am outraged at the whole situation, the easiest answer is YES! The mall has this right. They also have the right to not serve anyone who is not a "protected class." Even if they are a protected class, the mall could require a membership status and not allow certain members.

That is the beauty of this country! That is what the Conservatives are fighting for! We want to PRESERVE these RIGHTS!

So, being outraged is one thing, but calling to change the law to make this illegal is playing into the hands of the fascists!

Don't let the MSM and the propoganda and the ridiculous stories throw you off your game. That is their intention! They want us to fight amongst ourselves until the law books are full of laws that can be pulled out against anyone at anytime whenever it suits TPTB situation.

HERE IS THE NEW THOUGHT PROCESS TO FOLLOW WHEN VOTING OR DEBATING:

1. No new laws. Don't vote for anyone that will enact new laws. We have plenty! No new taxes, no new resolutions, nothing. Vote for someone who promises to do NOTHING, and will get in the way of anyone who does try to do something!

2. No incumbents. Get fresh blood at every level from commissioner to president. Corporate Obamatrons don't count! Vote for an entirely unknown bus driver or mechanic or dental assistant! Vote for somebody who needs the job; don't vote for someone who is already rich!

That is enough for now, but I think this is a decent start. We can add more later!

Let me add one important item to your list:
3. Make sure that we vote in a split government to insure that nothing gets done. Having one party control both Congress and the Presidency is a certain recipe for disaster. Look at what is happening now.

Good Addition!

The only way to be sure nothing gets messed up, is to be sure nothing gets done! We need to split the government between at least two, preferably more parties. Ideally, we could elect ALL 3rd party or independents. Send a strong message!

4. Do not vote for any Republicans or Democrats! Vote entirely off the charts! Do not vote for anyone you see on TV or on a street corner with a sign! If they have time to stand on a corner and beg for votes, they are not a common person like you and me! We have jobs to be at!!
