Spivack has contended that he's being kicked out of the mall for political reasons. He's traced his exile to a letter to the editor in the Charlotte Observer criticizing his business, saying it promotes “ideas such as racism, sexism and even slavery.”

He said he was at work again Sunday when he got a call from mall manager Ray Soporowski inviting to talk in his office.

“It was a pleasant, amicable conversation, but we didn't come to any resolution about whether our business would be able to stay in the mall,” Spivack said. “He wanted to include some of his company's senior

Well so much for the 1st amendment of the constitution.

This is becoming way too much BS that the race card is being thrown in every time someone says something negative against the POTUS. You know George W Bush was called a lot worse, and while he may or may not have deserved it, at least he never pulled the race card.

I was reminded of a video another memeber posted about people being pushed too far and they wouldnt take it no more.

Alot of people called that man a nutcase but events like this is what is slowly making this come true.

It's amazing how many democrats called for Bush to be impeached, and the MSM never condemned them. However, as soon as someone calls for the "messiah" to be impeached, holy war breaks out. Liberal hypocrisy at its worst.

And this is not a race thing, I'm black and no one I know voted for Obama and WE DO NOT support him, whatsoever.

Impeach Obama.... I agree.

This is not a mall I support if they kick people out for being conservative!

Here in liberal california I have literally been "attacked" before for openly showing my views about Obama.. I grew up in and LOVE CA though I have just as much right to be here as liberals!

People have even accused me of being racist! LOL! Yeah idiots, I hate my own people, you got me! *sigh*

Spivack has a right to free speech just as everyone else. However, a private corporate entity, such as a mall in this case, has a right to management. They are not in anyway encroaching upon his First Amendment rights, they're simply not allowing him to peddle his wares upon their property. He is free to open up shop in another venue and continue his business.

You may not like it, but the corporation is well within their rights to do so.

You know I agree with you Maria. What is pissing me off about the whole thing tho is this was stirred up because of the bumper sticker. Hell, he was gettin no negative comments for the baby bib that said "my parents chose life Thanks mom and dad!"

The problem with that philosophy is that the United States Government is now essentially a corporation. Perhaps that is why citizen rights keep getting taken away. Pretty soon the government will run all corporations, as they are well on their way already.

My neighbors are black too, and they are cool as hell. They are totally with you and myself here!

We were all against Bush, and now against Obama.

My black neighbor Rob, he said "Bush and Obama are the exact same, fascists". And I was like "dude, your so freaking awesome!"

The media lies about us all the time to try to make us fight. When in reality they know we are joining forces against their agenda to destroy our beautiful nation.

And I am glad that they have no chance turning us against each other. Because without each other, we may not stand a chance in hell at gaining power back for the People. Black Asian Latino White, we are the People and we want only 1 thing.

So a local mall has the right to put up a sign that says, "No Conservatives/Liberals/Other Party" allowed?

I do not think so, that is political discrimination. If this is legal, well the law needs to change!

My thoughts exactly, dude! They are just puppets and EVIL to the core, imo. Doesn't matter what color they are.

And yep the media are attempting to create more of a divide between the races and they are trying to paint anyone who doesnt like Obama as a "racist". Its rediculous.

Luckily more people are waking up and seeing this!

It's not just a local mall, but the biggest mall in North Carolina. I lived next to this mall just a few months ago. Interesting though the support the shop owner is getting from the community.

This is what gets me about this whole situation. His lease is about to be up and they are essentially kicking him out, by not renewing his lease.

So the mall is within it's rights by not renewing the lease, but the thing about it is they sell pro-Obama paraphernalia in the same mall. So they just got lucky by his lease running out. Because there is no legal recourse for the mall to kick them out.

Good news is some other malls in the area have offered him a place to set up his Kiosk. I do feel he could have a lawsuit possible, but there isn't a very good chance of him winning even though it is obvious that the mall is not renewing his lease because of political ideologies.

Oh yea, he same owner of this mall property, Simon (something or another) is the same company(person) that revoked the license from the people in Atlanta that were having a Tea Party protest, on Simon's property.

I have shopped at this mall as well, and you can darned sure bet I'll not shop there again.

I wonder what would happen if I wrote a letter to one of the local malls and complained that the vendor that sells Obama merchandise is offensive. Hey...I think I will. Bet you nothing except a letter (if that) dismissing it.

I saw this man inteviewed on TV.

He is not a nut job.

He's just a business man who sell politically oriented material--a lot of it humourous.

He said the Impeach Obama bumper stickers were meant as a joke. They went on sale the day after Obama was elected or took office, I'm not sure.

At any rate, the whole thing stemmed from one complaint from one woman who was working at another store in the mall.

It is just an example of how intolerant the tolerant left can be.

I heard on the radio that he also had a bumper sticker that read:

"Barack Obama is Kenyan for Jimmy Carter".


That was a good one.

Anyway, this is stupid move on the malls point, hopefully enough people will boycott the mall so they well feel it. I'm sure they are already feeling it now, with the way the economy is.

Political discrimination?!? Hardly.

Now, if he was asked to remove his conservative bumper stickers, then you might have a point. But they didn't. He was asked to vacate the premises, instead. There is no breach of the First Amendment.

People confuse freedom of speech and think it means you can say what you like and have no consequences. Just because you have a freedom to say something doesn't mean others need to stand by it and support you. In the private sector the owner can do what he feels will be best for the business and if he feels a certain store will cause him to get less patrons then he should kick them out.

Last time I checked there are many more people for Obama then against.

Technically, you're right. The mall is private property, but the man is being punished and his business jeopardized for selling material that offended one person, or at least only one person who complained.

I would bet a dollar to a donut that without much trouble that you can find some retailer in that same mall who sells something with profanity on it.

Well his lease is up. If they kicked him out of the mall because of an "impeach Obama" sticker there would be a major lawsuit underway.

Instead they just aren't going to renew his lease. So there isn't anything he can do about it.

And this is violating his right to free speech, when I'm pretty sure other shops in the mall sell pro-Obama stuff. There is nothing offensive about the bumper sticker. In fact it is discrimination.

On the contrary, he is still entitled to state his beliefs without hindrance from the government. So, his First Amendment rights are still intact. What he is dealing with at this point are the unfortunate consequences for upholding his right.

On the flip side, the mall owners are now dealing with the flack as a result of their actions. There is now a group of people are protesting and boycotting the mall. They (the mall owners) are now having to deal with the negative publicity as a result.
