On March 18, 2008, the CIA responded in writing to a FOIA request disclosing that the CIA's use of biomedical intellectual property developed at the Alfred Mann Foundation, Second Sight LLC, Advanced Bionics, and under Naval Space Warfare (SPAWAR) contract is "currently and properly classified pursuant to an executive order" and applies to the CIA Director's "statutory obligation to protect from disclosure, intelligence sources and methods.

This is likely what was discussed at Ashcroft's bedside on the ev of program expiration and what was called "other" intelligence activities. I guess the Constitution was also "waived" just like like the Congressional reporting requirements. This is what they're hiding in DOJ OLC memos.
