That is not always so. The laws about if when how to start CPR vary from state to state.

Some states, Paramedics are allowed to note and declare a person is already dead, prior to ER arrival.

Here in SC the law is ancient, and they get MANY D.O.A. patients RECEIVING CPR in progress.

The rationalization is you don't know how long, it was unwitnessed, and being aggressive like that is the least likely avenue to cause a law suit.

In theory, anyway.
