the geneva convention only allows the US to do what they are doing in camp x-ray because these people are not part of a recognised army, nor a nation's armed force. so, if they have declared war, and as such are being recognised as some sort of nation (which they can't) then the US is breaking the geneva convention. if they are "non-lawful combatants" then its not war and is indeed "criminal action".
