The Supreme Court says you don't, however this is concealed from the people, the media aren't giving it coverage and the congress and senate don't want to answer your questions about it. Do you know anything about the situation in the Rep. of Ireland, I assume we are all legally bound to pay income tax, but maybe the system in the US applies here also and we aren't legally bound to pay this money that simply funds the disgusting scumbags who control the banks

A group calling themselves The United Sovereigns of America, aka "We the People", also spout this rhetoric. They are correct in stating that the "Tax Amendment" was never properly ratified and did not have the proper number of votes for ratification, therefore it is not legally a real law. They are also correct in saying that payment of taxes is voluntary and that only excise tax is legal (and many other things non-tax related). Unfortunately that has not kept many of them out of jail for tax evasion. I personally witnessed this group legally serve a judge (who was hearing a case on tax evasion) with a cease and desist order. He laughed in their faces and had his bailiff toss them out. They attempted to get the county sheriff to serve this legal notice and the sheriff refused. They went to the state attorney and were laughed out of his office. Thing is, they had excellent legal representation from several constitutional lawyers but the courts have their own rules. In fact, when the cease and desist finally made it to court to be heard as to its legality, the judge hearing that case said point blank, "you mention the word 'constitution' in my court again and I'll hold you in contempt". Paying your taxes IS voluntary. So is stopping at a red light, however, you ignore both at your peril.
We live in corrupt times, my friends, and we are literally paying for the rope to hang our constitutional republic selves by obeying the illegal taxation "laws". If any of you know of a way to avoid paying taxes and avoid staying out of prison, please enlighten the rest of us. I've seen first hand how trying to play in the legal arena works and it's not pretty for tax evaders.

They will garnish your wages and although you may think you do not have to comply, I promise your employer will not share that opinion. Half of every paycheck will go to your rich Uncle Sam. They will also put a lien on any real estate you have so that you can't sell it without giving the IRS their cut first. If none of this works, they will throw you in jail.

If legal tax evasion were possible for those of us without armies of lawyers and accountants, then more of us would be taking advantage of it, don't you think?

I have an associate who taught lectures about this subject (not paying taxes at all) in the early 1980's. He spent most of the the late 80's and early 90's in prison for tax evasion. Here's a joke for: What's the difference between tax avoidence and tax evasion? About 15 years. Yeah, I know, it's IRS humor.

There are many ways to legally avoid or minimize taxation, none to evade them. Most people overpay on their taxes and don't even realize it.

The operative word is not “evasion” but ‘avoidance.” The former is a no no the latter is the basis of a substantial industry. It is not a crime not to pay your taxes provided you 1) truthfully and timely complete and file all required reporting forms, 2) you do not have available to you the assets out of which to pay those taxes and 3) you have not frivolously or willfully squandered, disposed of, given away or otherwise purposefully rendered yourself insolvent or incapable of paying the tax due. No one is in jail who could not pay his taxes if he or she otherwise fully complies with IRS rules and has not been convicted of fraud. The IRS can only bring charges, it is not like the KGB, it cannot confine you on its own authority. Only a Federal judge can put you in jail.

It is a crime to file a false tax returns. Most people lose on this ground, as very few refuse to file a return, almost everyone knowing the difference. Most of the losers have failed to make truthful and complete returns wen due or to have requested extensions.

Note here that the request for an extensions requires you to pay the “apparent” tax with the request. There is no extension for paying your taxes when due. Only an extension in time to file the return. If you fail to inclose sufficient funds with the request, you will be required to pay penalties and interest from the original date due, usually April 15.

The bane of small business persons is the failure to maintain a separate payroll account into which the employer should pay enough to cover all the expenses related to employing others. The 7.65% matching money for the SS and Medicare tax. 3.2% for unemployment insurance. Plus whatever amounts state and local taxes require to be withheld and paid later to the particular taxing authority. I added the Workers Compensation insurance premiums when I had that responsibility. I also added the cost of temp help when the employee was on vacation, so my payroll account was always adequate funded. I used 122% of wages as the amount to be deposited each week in the payroll account.

All too many small businesspersons do not do this, and when the tax bills comes due, they do not have the money. They have failed to realize that these funds are not a “tax” they owe, per se. The employer has been made a trustee for the employee’s taxes and the money does not belong to either the employer or the employee. It belongs to the governmental taxing authorities. Not to pay the withheld funds as due is theft, pure and simple. Taxes only become involved when calculating the amount of the theft.

All the taxes assessed by the United States of America consume 10 pages in the Tax Code. More than 3.000 pages following set out and define various deductions, exclusions and credits against those assessed taxes. The ultra rich have finally achieved a “flat tax” for themselves. 15% on dividends and 10% on long term capital gains. All the rest of us who earn our income by the sweat of our brow still pay various tax rates up to 32% plus a so-called millionaire’s sur-tax of 10% making the top bracket 35.2%.

History. This notion that the IRS was illegal arose from two anomalies in the admission of 2 states to the Union. 1) West Virginia was a part of the state of Virginia until the Civil War. The western 27 counties were anti slavery and wanted to separate from Richmond. Congress admitted West Virginia in 1863. The US Con says no state can be created out of another state without the consent of that state’s legislature. After the war, Virginia argued the admission of WVa was contrary to the Con. The Supreme Court said, “No, “ Virginia had seceded from the Union and could not claim protection udder that document.

2) Around 1970, someone discovered the papers admitting the Sate of Ohio to the Union in 1803 had never been sighed. On this basis then some people argued Ohio was not a “state” until the papers were signed in the 1970s. The 16th Amendment which gave Congress the power to tax incomes from whatever source derived, had been approved by both WVa and Ohio and those states were counted in the required 3/4ths for approval.

Therefore, it followed by their logic, the declaration of acceptance of the 16th Amendment was in error because 2 of the states were not actually “states.” Premature. The Supreme Court has never felt this issue merited its time and it has never ruled on this claim. This claim has been rejected outright by several Courts of Appeal. When the Supreme Court declines to review a case appealed from one of the 12 Courts of Appeal, then the law is, the Appeals Court decision stands. Which says “No” to the claim the 16th Amendment is illegal. It’s frivolous.

Like I've said in numerous threads, "You can't just say OH income tax is illegal! then I quit!", You have to study the law, you have to know about admiralty maritime law, contract law, you have to put your assets in a non legal fiction -gov't controlled entity, then you have to work in your own capacity and not that of the fiction nom de-guere / all caps debtor slave.
You have to know wear you stand in the law and who you really are and knowledge of your rights before you enter a court room. It takes at least 2 years of carefull study of legal terms and definitions cause words mean different things in a court room and are continually re-defined by varoius legislation to trip you up. Once you can read the true meaning of the Acts, Bills, & legislation you can terrify the prosecution and they will just leave you alone for being too "knowledgable"

Only corporations have income, not men & women, however everything you think you own is written in ALL CAPITAL LETTERS, look at your drivers licence, power & phone bill etc. This all capital name was created when you were born when your mother filled out your birth certificate application. The gov't created an agent in trust because every gov't in the IMF is bankrupt and is a bankrupt corporation itself. The gov't offers you benefits like social security pensions & child tax benefits. The acceptance of these benefits makes you an officer (nom de-guerre), when you register for school, they always spell your name: DOE, John. This entity holds a gov't created office called "The taxpayer" in order to recieve benefits. When you buy gas at a petrol station you are a tax payer on the fuel but when you do income tax you hold an office called "The taxpayer"; 2 seperate entities in law. Just like a gun is not a "firearm" until it is registered in law. Like Ronald Regan said "everybody is an EMPLOYEE of the federal gov't". If your state or province is also in debt they spell your name in all capital letters JOHN DOE, to signify your gov't created legal fiction is a debtor slave. Your income tax, & all correspondance with the law is always dealing with legal fictions written in all capital letters to signify an officer or a debtor slave. If you can refute this by getting the judge to recognize your status as a man with all your unalienable rights and not the representative of the legal fiction your case will get thrown out of court or moved to a common law court which still exist in the most strangest of places. In a court of common law no Act of law can harm a man only fictions. There a lots of websites about this but remember you can't just go into court without some serious knowledge because everything coming out of the judges mouth will continually try to get you to become the representative of the legal fiction.
Everyone that works in Canada with a Social Insurance number hold the gov't created office called the "Taxpayer" not a tax payer. The officer must remunerate some of its military script (fiat paper money) back to the captain of the ship cause the gov't is always in a state of war. A simple notary of the public stamp on an affidativ or document in regards to a flesh & blood man or woman cannot be undone by the supreme court; in this regard a notary of the public is more powerful than a supreme court justice.
This is also why the law will always provide for you a court appointed lawyer, not because they care about you, but because if you accept a lawyer you become a ward of the state where the judge consider's you a ward of the court, imbecile, or infant without the capacity to represent yourself.

In Canada, we have the "Charter of rights & freedoms", only ships can have charters. In Canada everyone sends their income tax return to the "Reciever General" because the gov't of Canada is in receiver"ship" / bankrupt. The ships that sent goods back and forth between England & the Colonies were called "revenue cutters". This is why it's called Revenue Canada & Customs because Customs is also the "port authorities".
In Canada everybodies agent in trust / legal fiction that was created to conduct commerce with the bankrupt company (gov't) is written in capital letters except Alberta because Alberta is the only province not bankrupt, however the people still hold an office and their driver's licenses are written in nom-deguerre to represent on officer just like all court summons.
Look at a Canadian 5, 10, 20, 50, or 100 dollar bill. It says Bank of Canada note, now look at your birth certificate, it has Bank of Canada note on the back. Why?
