New Orleans will force evacuations

NEW ORLEANS, Louisiana (CNN) -- New Orleans' mayor issued an order Tuesday night authorizing the forced removal of people refusing to leave the flood-ravaged city.

Mayor Ray Nagin instructed all public safety officers "to compel the evacuation of all persons ... regardless of whether such persons are on private property or do not desire to leave," according to a written statement from his office.

The order did not apply to people in Algiers on the West Bank side of Orleans Parish.

Many residents have refused to leave New Orleans despite a mandatory evacuation and warnings from government officials that staying in the flooded city represents a health risk.

I smell lots of trouble a brewing here... but realistically, and seriously, they do face a horrible health crisis if they stay. So bad, in fact, that they could put all Americans at risk. I agree they have to leave, for awhile.

I may be wrong, but wasn't the area under martial law? If so, wouldn't that mean that so long as the military authorities back the mayor on his order for people to leave, they have to leave?

No martial law was never declared, as a matter of fact the mayor and governor would not release control of the rescue operation to the feds, LAST WEEK.

It is the peoples and presses quick reponse to blame the government at all levels that forced political members to exert force in order to achieve what the collective american popular opinion says they should be responsible for: individual's safety, even if their safety depends on the federal government being empowered to protect citizens from theirselves.

Did we not ask for this?

Did the collective opinion being broadcast on news agencies not support this?

seriously, those people CAN NOT be allowed to saty, what will they live of ? the flood waters are contaminated... the houses can colapse at any moment... If they are no removed and something happens then they'll complain the mayor did not removed them... It is horrible but i do believ its for their own good. There are no means to live in that area, and there wont be for a long time.

The language contained inside the LA statutes does not include the specific language as ‘reported by news’ nor can the state of LA declare true ‘Martial Law’ in and of its’ own volition.

The persons of LA are not going to become adjudicated nor tried in courts martial, the powers as given, when invoked, are limited and specific.

Except of covering law:



CHAPTER 9. LOUISIANA HEALTH EMERGENCY POWERS ACT; RS 29:760

iii) A disaster, including but not limited to natural disasters such as hurricane, tornado, storm, flood, high winds, and other weather related events, forest and marsh fires, and man-made disasters, including but not limited to nuclear power plant incidents or nuclear attack, hazardous materials incidents, accidental release or chemical attack, oil spills, explosion, civil disturbances, public calamity, hostile military action, and other events related thereto.

Good they need to get out of there. And if they don't want to say and they get a disease/die/shot etc. They will blame it on the goverment for not getting them out even though they won't leave. It's just how it goes

States can declare martial law if the state has made the necessary statutory provisions for the ‘event’.

Martial law can not be declared when/where (even regionally) civil courts are still in operation.

States, historically, have placed certain areas or regions under martial law (San Francisco 1906, San Diego 1936….)

The State of LA does not have the necessary statutory language, the declaration of 8-26-05 by LA was a ‘limited state of emergency’ suspending some laws which was to end 9-25-05 unless otherwise stated. (See above post for entire LA statute)

This will get interesting.

The Big Easy, transformed into Atlantis, transformed into Waco, and eventually, I'd wager, it will become Fallujah. If people tell the government they don't want to leave their homes under any circumstances, it behooves the government to listen to those people. Think of the refugees, angered by what they see happening, they're spread out all over the country. It would be anarchy if they were to revolt as well.

Stubborness has already been exhibited by the ones who remained. Testing their resolve will almost certainly lead this country down an even darker path.

The government seems to be enticing the people, goading them towards an ill-conceived revolution that will be crushed without mercy. If this is indeed the case, I suspect it may already be too late. Perhaps though, in a stunning twist of fate, Americans will be delivered from tragedy by the very apathy that has landed them in this pickle. If they refuse to take the bait, the country will collapse in short order under its own debt, and international business will fly away to pick some other carcass clean, this one being exhausted.

I expect that will be the case. It's just the sort of irony the universe loves. Saved by our own sins. Gotta love it.
