Yes. Having no previous convictions is a relevant thing when it comes to sentencing.

It's just that chance of even one innocent person being executed, is what troubles me most.
I can be compensated and released from a miserable, damaging, prison spell, but a high court appeal judge can't bring me back to life!

I'm only talking about a safeguard for innocent people though, not the "sanctity of life" or whatever.

Agreed.

There is no appeal from death and there have been far too many miscarriages of justice leading to wrongful convictions.
