Ok… but under NY law the misdemeanor crime of falsifying business records becomes a felony if it was for the purpose of breaking a federal law.

And they would have to use a Federal case as precedent because they can't legally make a determination a Federal crime was committed by Trump without a Federal conviction, which Trump does not have. Cohen's Fed convictions do not make Trump guilty of any Fed crime(s). Only a Federal Court can convict. 😀
