Donald Trump’s deputy White House counsel, Pat Philbin, was nervous.
It was just a few days until Jan. 6, 2021, when Congress was slated to certify Joe Biden’s victory in the 2020 election, and Trump had suddenly resuscitated a plan to replace the leadership of the Justice Department with Jeffrey Clark, a little known DOJ official who Trump expected to mount a sweeping nationwide effort to help him remain in power.
So Philbin called Clark, a colleague from their days in private practice dating back to the 1990s and tried to talk him out of it.
“I tried to explain to him that it was a bad idea for multiple reasons,” Philbin recalled Tuesday at a long-delayed disbarment hearing for Clark. “He would be starting down a path of assured failure … If by some miracle somehow, it worked, there’d be riots in every major city in the country, and it was not an outcome the country would accept.”
Though Philbin has spoken to both the Jan. 6 select committee, and the federal grand jury that indicted Trump for his effort to seize a second term, no transcript or recording of his remarks has even been released.

Obama had his " Fifth Columnists " well Entrenched in the Federal Agencies and the Military Well Before Mr. Trump was sworn in as Our 45th POTUS . Even After serving 4 Years as POTUS Mr. Trump Never could Identify and Remove All of them .

White House counsel are not the President's personal lawyers.
There was nothing in the Constitution that supported what Trump was attempting to do. That's what White House counsel told him.

One might also call Trump a traitor but for one thing. A traitor once had loyalty to the cause they are turning against. Trump never ever had loyalty to anything but himself.

White House Counsel answers to the Office of the President. As was established during Watergate, attorney-client privilege does not apply when White House Counsel advises the President on personal matters.

Yes. The man trained in Constitutional law specifically focused on Presidential authority knows more about Constitutional law specifically focused on Presidential authority than a man that can't spell hamburger.
That's the whole point of the Presidential support staff. To become experts in every possible field that may come up in the day-to-day duties of the President and advise them based on that expertise.
WH Counsel informed Trump there were no provisions in the Constitution to overturn an election. Any actions Trump took after that to overturn the election were no longer the responsibility of WH Counsel as Trump was acting outside of the duties of the Office of the President.
