The federal appeals court in the Washington case unanimously ruled to uphold Judge Chutkan's gag order in the election interference case, modifying it narrowly to allow certain types of speech that are not intimidating or harassing. While he will not be allowed to attack and intimidate the court staff or the witnesses, he is being allowed to attack Jack Smith. He can also respond to potential witnesses, but if it is completely unrelated to the cases, or their testimony.

For example, if a potential witness wrote a book, or posted something personal, Trump could comment on that, or talk to them about that. If someone said they were going on vacation to the Bahamas, for example, he could offer them recommendations on lodging or restaurants.


“Mr. Trump’s documented pattern of speech and its demonstrated real-time, real-world consequences pose a significant and imminent threat to the functioning of the criminal trial process in this case,” Judge Patricia Millett wrote for the court, noting that many of the targets of Trump’s verbal jabs “have been subjected to a torrent of threats and intimidation from his supporters.”

Though Trump has a constitutional right to free speech, she noted, he “does not have an unlimited right to speak.”

But he does have an undisputed right to speak about anything that is not related to the court case, and he can even attack the prosecutor.


“The interest in protecting witnesses from intimidation and harassment is doubtless compelling, but a broad prohibition on speech that is disconnected from an individual’s witness role is not necessary to protect that interest, at least on the current record,” the court wrote.

“Indeed,” the opinion says, “public exchanges of views with a reasonably foreseeable witness about the contents of his forthcoming book are unlikely to intimidate that witness or other potential witnesses weighing whether to come forward or to testify truthfully.”

One appeal remains -- to the Supreme Court.

He does have a right to face his accusers, in court. He can not attack and disparage them outside of court, as he has been doing ceaselessly.

The gag order was upheld, unanimously. And it moved quickly. This means he can now appeal to the SC, and if they act quickly as well, all these gag orders in different cases will have an answer soon.

Right now, I don't have time. you can look it up, look up AG James or Jack Smith press conferences they bash Trump with no evidence. You know, get the masses the sound bites. They believe anything they are told. The court of public opinion is the only guilty they will get...in the end.

If you can't do your own research, I will be back in 12 hours or so and do it for you. I have 25 to house and 60 to places.....the suck button doesn't turn itself on.

Being a bully online or offline is a huge tell of character and intentions.
