They were definitely illegal for him to possess. As of 12 PM on January 20th, 2021 any Presidential and government records in Trump's possession became property of the US government and were supposed to be handed over to the care of NARA.

As for the classification status, NARA found documents with classified document cover sheets. Trump has yet to provide anything to support the claim they were declassified and both the DOJ and Trump's own lawyers are proceeding as if the documents are classified.

Cool story.

So wheres the charges?

Trump doesnt have to prove his innocence.

Because it sets a dangerous precedent. It would mean that former Presidents have executive privilege. Which has never been the case until now.

If Trump took Air Force 1 when he left the presidency and refused to give it back claiming that he partially owned it as a former President, pretty much everyone would think it's ridiculous claim. So why should Trump be allowed to make a similar claim regarding these documents.

As I've expressed in the past, the DOJ will go for a grand jury indictment. This is supported by the fact that they went the grand jury route for the subpoena.

It will take time for a grand jury to be convened and we're not even sure if the FBI has concluded their investigation and handed it off to the DOJ.

On top of that, Garland has indicated that any indictment most likely won't come until after the midterms.

Or maybe it's because the DOJ state in their filing that the image has been redacted due to sensitive information.

Vs the insane precedents fbi and democrats have been setting in places like fisa court and impeachment hearings?

You should actually want someone independent to verify this, or at least half of the country will NEVER believe any of the results, even if you are successful.

democrats and fbi have lied FAR too often for anyone to take anything they say about Trump as true without independent verification.

Show the evidence if you have it.

…won’t come until after the midterms is code words for

We got nothing.
This will hurt the Dems when he skates again.
Holding until after the election optimizes the FUD.
He skates again.

Trump has no standing to request a special master for executive privilege as A.) He doesn't have executive privilege and B.) He has no possessory interest in the documents as they solely belong to the US government.

If Trump is indicted, his team will have a chance to review the evidence against him during the discovery phase and then question its merit during the trial.

Hehe

What trump did is so serious that partisan hackery takes precedent.

His alleged crimes, so damaging, that theyre waiting until after an election hes not in.

Such damaging evidence that after having all of it, a GJ, thats already conviened, is to spend months of investigating....and we all know how GJs are with indictments.

Hilarity

Shouldn’t the NARA know exactly what was missing and in Trump’s possession to the point of being able to make a list for those that can read it and then publicly said that items 22 through 187 as an example?

I mean I used to get a list of missing trailers when I drove that the company would give us a reward if we spotted one and told them where it was at.

The documents have all theoretically been retrieved so that diminishes most of the risk. If the DOJ actually suspect that Trump was selling state secrets he'll be placed under surveillance and if he tries to sell any other secrets he would be arrested at that time.

Otherwise, the DOJ's unofficial policy is not to make any moves that could affect an ongoing election. Trump may not be running this year but he is the de facto leader of the GOP and his arrest would definitely impact the midterms.

So the empty folders are a red herring then....?

Which flies in the face of not only the 6th amendment but the whole story of the seriousness of the matter.

The only way NARA would know what documents Trump might have is if the Trump administration provided them with their classified document log. And even then that would only account for the classified documents, not the 10,000+ pages of unclassified Presidential records that have been retrieved.

Jesus Christ.

This has turned into a a taco fart at church.

Why won't you evil leftists just apologize, say, "My Bad" and walk away from this fecal-fest instead of defending it?

Do you guys hate the Constitution that much?

That would be AFTER democrats got what they wanted with yet more false allegations with zero evidence - assistance with their disastrous midterm polling numbers, which is why they scheduled the fake raid when they did.

We didn't have standing in the fisa cases either, but we eventually uncovered the democrat and fbi lies.

Now we have the same players playing the same game with the same evidence, in the same way, just in time for midterms, and everyone is supposed to just take their word for it?

I highly recommend you watch that "Boy Who Cried Wolf" cartoon again, it seems you may have fallen asleep before the lesson was finished.

Obviously.

The question was directed more at your perspective on it rather than the very limited facts available.

As it relates to the quote.

Because then they would have to also include the past 6 years.

There is no "stop digging" from this hole they created.

The facts as we know them:

1.) Beginning in 2021 NARA started requesting the Presidential records that were supposed to be turned over at the end of his presidency.

2.) After requesting the records for a year, Trump turned over 15 boxes of records to NARA.

3.) Upon reviewing the documents that were handed over, NARA discovers classified documents mixed in with unclassified documents.

4.) Worried this may be a case of mishandled classified information, NARA reports their findings to the DOJ in February.

5.) In June, the DOJ shows up at MAL with a grand jury subpoena for any remaining classified documents.

6.) The DOJ investigators are allowed access to Trump's storage locker, where they retrieve about 50 pages of classified information.

7.) Trump's lawyer signed a document attesting that all classified documents had been handed over.

8.) Between June and August a confidential informant makes contact with the FBI and informs them they have evidence that Trump still has classified documents at MAL.

9.) Upon reviewing this evidence the FBI submits an application for a search warrant on August 5th.

10.) On August 8th the search warrant is executed and over 100 more pages of classified information is retrieved from the areas specified by the CI.

So we know that Trump had classified documents stored at MAL. We know that MAL is not classified as a secure storage facility for classified documents. We know that the classified documents were stored in boxes mixed in with unclassified documents. We know that classified documents were still on-site after investigators were told all documents had been handed over

So I fail to see where the is any malfeasance on anyone's part other than Trump's team who failed to comply with a subpoena and then lied to investigators.
