Federal prosecutor Deborah Brittain Shaw delivered the government’s opening argument, saying the case is one "about privilege."
"Privilege of a lawyer who thought he could lie to the FBI without consequences; privilege of a lawyer who thought that for the powerful, normal rules didn’t apply," Shaw argued on behalf of the government.
The government argued that in bringing the "serious allegations" to the FBI, Sussmann "bypassed normal channels and went straight to the FBI’s top lawyer," then-General Counsel James Baker.
"He then sat across from that lawyer and lied to him," Shaw said, noting the lie was "designed to achieve political" ends, and "designed to inject the FBI into the election."
The government, in delivering the argument, wanted to "address the proverbial elephant in the room."
"Some people have very strong feelings about politics, and about Russia, and many people have strong feelings about Donald Trump and Hillary Clinton," Shaw said. "We are not here because allegations involve either."

Baker falls at the center of the trial. Sussmann has been charged with making a false statement to the FBI when he told Baker in September 2016, less than two months before the presidential election, that he was not doing work "for any client" when he requested and attended a meeting where he presented "purported data and ‘white papers’ that allegedly demonstrated a covert communicates channel" between the Trump Organization and Alfa Bank, which has ties to the Kremlin.

The former top lawyer for the FBI testified Thursday that he was “100% confident” that Democratic lawyer Michael Sussmann told him he was not representing a client when he approached him in September 2016 about purported ties between a Russian bank and Donald Trump.
The testimony by James Baker, the FBI’s former chief counsel, is viewed as crucial to special counsel John Durham’s charge against Sussmann that he lied to the FBI when he told Baker he was not representing a client during their meeting.
According to prosecutors, Sussmann was actually acting on behalf of the Hillary Clinton presidential campaign and a private cybersecurity researcher as part of an effort to gin up an “October surprise” by getting the FBI to investigate the alleged Trump-Russia link.

The jury in the trial of former Hillary Clinton campaign lawyer Michael Sussmann began deliberations on Friday, after both the prosecutors of Special Counsel John H. Durham’s team and the defense attorneys delivered their closing arguments.
Sussmann is accused of lying to the FBI when he claimed to be acting as a private citizen when handing the FBI information in 2016 about a supposed connection between then-candidate Donald Trump and the Russian government via Alfa Bank.
That information, part of the broader “Russia collusion” conspiracy theory that the Clinton campaign was attempting to spin, was false, and fell apart under scrutiny. But the Clinton campaign, including aide Jake Sullivan — now the National Security Advisor to President Joe Biden — fed it to the media, regardless.
