I am against death penalty in all cases, as there's always the possibility of an error, and there's no coming back from death (as far as I know).
But I'm also a fan of attenuating circumstances, and this is a clear case for that.
The fact that the man tried to do things the right way, by warning the police, shows that revenge was not his first idea.
Should there be a trial? Yes, always, otherwise we end up with a justice system that some times works one way and other times works in a different
way. But, as I said above, all the circumstances should be considered and, to me, if I was in a jury or a judge, I would choose to give the man the
lightest sentence possible, if any.
