The UN only views nuclear weapons as weapons of mass destruction however bio and chem weapons are not classified as such by the UN. The US views nuclear weapons, biological and chemical weapons use as weapons of mass destruction. Our nuclear doctrine says we can strike with nukes as a response.

China got caught and is desperately trying to scare away any accusation / response.

Finally the US has way more nukes than China.
