Depends on where you're from. Gotta remember there wasn't always a breathalyzer test.

When I was stationed in Fort Hood, TX (back in the early 80s) we were allowed to drive on the side of the road with our emergency lights flashing. Not allowed on the hardball ... that'd draw you an ass whoopin' ... but there were no tests for any kind of limit. Cops smelled it on you, you admitted you had been drinking, or you staggered ... that, and a judge's decision.

It ain't been all that long ... and if it weren't for MADD ... it wouldn't be the big damned deal that it is.

So like I said earlier in the thread.. DWI was fake news.. DWI charges dropped.. He drank in a public place and will accept that responsiblity.
