Right. It's the states. And they have done so. Or are you now going to rely on faithless electors?
“Each State shall appoint, in such Manner as the Legislature thereof may direct, a Number of Electors…” (Article II, Section 1). State legislatures can even choose to forego a popular election altogether and directly appoint their electors, as many states did in the early years of our republic.
Which doesn't have to be chosen because of the popular vote... at all.

I've argued that very point very many times. It's nowhere in the Constitution.
