It’s been less than a month since Amy Coney Barrett joined the Supreme Court, but at least one state is already gearing up to give the conservative darling a chance to take down legalized abortion in the United States.

An Arkansas legislator filed a bill last week that would ban almost all abortions in the state, in direct defiance of Roe v. Wade, the 1973 Supreme Court decision that legalized abortion nationwide. And he wasn’t even subtle about it.



This will be an interesting issue soon. The potential illegalization of abortion, through probably a 5 4 vote in favor of getting rid of Roe Versus Wade.




“It is time for the United States Supreme Court to redress and correct the grave injustice and the crime against humanity which is being perpetuated by their decisions in Roe v. Wade, Doe v. Bolton, and Planned Parenthood v. Casey,” reads the bill, which was introduced by Republican state Sen. Jason Rapert and name-checked some of the other most consequential Supreme Court abortion cases. “It is the intent of this subchapter to ensure that abortion in Arkansas is abolished and protect the lives of unborn children.”

The bill would ban all abortions, except in cases where they are needed to save the life of a pregnant woman, remove an ectopic pregnancy, remove a miscarried fetus, or “save the life or preserve the health of the unborn child.” There are no exceptions for rape or incest.

If someone performs an abortion or attempts to do so, they could face fines of up to $100,000 or be imprisoned for up to a decade.



Another divisive issue in America for folks to debate and stew over.

Making abortion illegal will have a tremendous impact on the political landscape...

The Abortion Issue, is only complicated by the issue of many of the people wanting abortion to be legal, also want the Death Penalty abolished. So at a very basic level how can taking a life in one situation be ok while it is not ok in another?

Until the pro-choice side and come to terms with that paradox, they are going to be on the losing end of any logical discussion over the matter.

The left have been screaming about this every single time a republican president puts in a SCJ, every.........single.........time and its never happened.........not even close.

Abortion in the USA will never be "illegal".

Simply because that would be impossible to enforce... my abortion I did myself with a rat-tail comb, for instance.

There are plenty of natural abortificants out there as well that have been used for centuries.

However, it doesn't need to be subsidized by taxpayers.

It shouldn't be marketed as a contraceptive to cash in on selling baby parts.

It should also be (quoting Obama who quoted Clinton) "Safe, Legal and Rare."

So there needs to be some restructuring there, of course.

And if abortion was actually made illegal it would need to be passed into law by the Legislative Branch.

Not be the result of a SCOTUS ruling, which by definition isn't a "Law".

Same point though, if the state wants to allow the Death Penalty, then they are also going to need to accept abortion. It really doesn't matter which side of the argument a person chooses to stand on, they can not make one illegal and the other legal.

In the last two cases, the SCOTUS took the pro-abortion side won 5 to 3, then 5 to 4, in another case when Roberts surprisingly voted on the liberal side.

So, the cases are very close, and with a 6 3 conservative majority, some states may ban abortion and get the backing of the court.

So it's entirely possible.

It's NOT any straw man.

It will still be legal elsewhere
There are still dry counties and states that don't allow recreational marijuana
that doesn't prevent people from traveling elsewhere to buy booze, or smoke dope, or get an abortion

States have a constitutional right to pass laws they see fit for their own states........Supreme Courts job is to honor the constitution has nothing to do with bias.......there should be no activist judges period, especially in the Supreme Court

We do have states that now allow a "Right to Die" rule so that people with health issues can choose to commit suicide. Suicide is at its base form Murdering of one's self. So yes, states do allow murder under some circumstances. So can you explain how legal suicide, abortion, and the Death Penalty are not all the same thing? They are in fact murder under special considerations, if one is allowed then so should the others.

If you feel differently, then please explain how they are all different.

Yeh, Arkansas cares so much about saving the unborn, that they have the 5th highest maternal mortality rate in the nation,

This is a very divisive issue. The extreme sides are very dogmatic in that their side is the absolute right, and the other side is evil. I wouldn't dimmish the reality that it is a very divisive issue.
Murders have been committed over this. Though, maybe it has gotten less divisive.


Personally, I'm very conflicted about this.

Is there a middle course?

I am convinced the only way to end this debate is a compromise that leaves both sides somewhat unhappy without recourse to bitch about morals and freedoms.

Artificial wombs would make abortion unnecessary.

The right could only groan over the additional financial strain on the state from unwanted children the left could only groan about how the procedure wasn't quick or simple, but their original arguments would be null and void.

If either side really wanted to solve this issue based on their original arguments they would push for research funding on artificial wombs.

If you can't tell the difference between a person using trained help to end the suffering of their chronic pain in a terminally ill situation, and willfully killing another human being against their will, then I doubt that you're able to have a serious discussion on this matter.

So you don't think the SCOTUS should intervene?

But it's the state that is passing these laws.

I believe this boils down to a constitutional issue in that Roe v Wade says it's a 14th amendment right of privacy, I think that states CAN'T make it illegal. until Roe is overturned.
