9th Circuit Court Hands President Trump the Win on Sanctuary Cities


The once notoriously liberal 9th Circuit Court ruled in favor of the Trump administration to prioritize federal dollars for policing in sanctuary cities.

The city of Los Angeles first sued the Trump Administration after it was denied $3 million due to its immigration policies.

This is a huge win for the rule of law.



The Hill reported:

The 9th Circuit Court of Appeals on Friday ruled in favor of the Trump administration’s efforts to prioritize federal dollars for local policing to towns and cities that complied with certain immigration policies.

A win is a win and California seems to be on a losing streak lately. The state Supreme court already ruled part of their sanctuary city law unconstitutional since CA law on cities that have a particular type of government classification (home rule charter etc) arent required to follow certain laws if it conflicts with the city charter law (The law governing how cities are incorporated / population / government setup / etc and the sanctuary city law were in conflict with each other and the city charter law took precedent).

Now the 9th circuit sided with the DOJ when it comes to grants and state funding. Los Angeles lost more than $3 million in a federal grant because they are a sanctuary city. When the grant was denied LA sued, claiming they were being punished (they were and rightfully so). The 9th circuit ruled the DOJ has the authority to award their grants and deny cities grants based on that agencies policies.

I find it pathetic that Democrats want money from the Feds but think they are not required to follow the law / guidelines in order to obtain the money.

Their mindset is up there with the recent changes to federal income taxes and the changes made to SALT, reducing the cap down to $10k. New York has sued the federal government by changing tax law that says a person can now only claim $10k as a deduction based what they pay in stat taxes.

New York lost about $2 billion in tax revenue however the Feds have every right to make the changes since its a federal tax. New York then tried to change state law, attempting to classify real estate tax over 10k as a "charitable contribution, there by allowing it to bypass the federal limit cap. The Feds just closed that loophole NY attempted to make by banning it from being claimed under Federal tax law.

In other words the change to federal law affected people who are millionaires, forcing them to pay more in taxes. Democrats, who constantly preach they are for the little guy, attempted to restore a tax break to millionaires. The hypocritical irony when Dems talk about Trumps tax breaks and how they only helped the rich.

Back on topic Trump has appointed several judges to the 9th circuit along with federal district judges in CA. Feinstein and Harris were bitching because Trump is not appointing CA judges to CA district courts (internal promotions so to speak). That action counters the liberal bias federal district judges are showing in CA, ignoring the law / constitution and replacing it with legislating from the bench.

A federal district court in the OP already ruled in favor of LA, saying the DOJ couldnt withhold grant money, which is fricken insane.

While Gov. Newsom (he is Nancy Pelosi's nephew) keeps claiming CA has a budget surplus, he and others fail to mention that fact the state of CA is in debt to the tune of $1.3 +/- Trillion dollars (state/local governments / unfunded liabilities etc).

But by all means lets spend taxpayer dollars on illegal aliens. Never mind the fact homelessness in CA is thru the roof.

California is getting what they deserve, if you are going to let illegal immigrants hide from ICE in your state then you shouldn't get any funds that you are going to use to help them.....or pad your own pockets.
Let this be a lesson to all the other sanctuaries.
Now MAYBE the California tax payers will start to see the light when even more of their money will go to illegals because they aren't getting it from the federal government

Sanctuary cities faced losing out on Federal Grants in the law enforcement area because of their sanctuary status. Los Angeles applied for a federal grant under community policing totaling 3 million dollars. The Department of Justice denied LA the grant because the requirements under the community policing grant stipulates cooperation with federal agencies.

As a sanctuary city LA does not meet the grant requirement - cooperation with federal agencies (namely ICE). LA sued the DOJ claiming they were being punished for being a sanctuary city and argued they were entitled to the grant money. A federal district judge ruled in favor of LA. The DOJ appealed the verdict and the 9th circuit court of appeals overturned the lower court ruling, stating the DOJ has a right to disqualify entities applying for grants when they dont meet the federal criteria for the grant.

I am wondering why the DOJ has not gone after these politicians for violating 8 USC 1324 1(A)(iii)(iv).

8 USC § 1324. Bringing in and harboring certain aliens

(a) Criminal penalties
(1)
(A) Any person who—
(i) knowing that a person is an alien, brings to or attempts to bring to the United States in any manner whatsoever such person at a place other than a designated port of entry or place other than as designated by the Commissioner, regardless of whether such alien has received prior official authorization to come to, enter, or reside in the United States and regardless of any future official action which may be taken with respect to such alien;

(ii) knowing or in reckless disregard of the fact that an alien has come to, entered, or remains in the United States in violation of law, transports, or moves or attempts to transport or move such alien within the United States by means of transportation or otherwise, in furtherance of such violation of law;

(iii) knowing or in reckless disregard of the fact that an alien has come to, entered, or remains in the United States in violation of law, conceals, harbors, or shields from detection, or attempts to conceal, harbor, or shield from detection, such alien in any place, including any building or any means of transportation;

(iv) encourages or induces an alien to come to, enter, or reside in the United States, knowing or in reckless disregard of the fact that such coming to, entry, or residence is or will be in violation of law; or


(v)
(I) engages in any conspiracy to commit any of the preceding acts, or
(II) aids or abets the commission of any of the preceding acts,
shall be punished as provided in subparagraph (B).

the healthcare penalty as we know, was ruled unconstitutional the end of last year or beginning or this year (can't remember off the top of my head), and as of tax year 2020, no American citizen will be required to pay a penalty for not having health insurance.

What i think is that the damn government should write everyone a check that had to pay penalties in the past. Talk about reparations

While I strongly disagree with the entire concept of sanctuary cites I am worried about federal overreach and the message that is being sent here. I think that while this is clearly a win for Trump it could also be used against Republican city or state administrations by a Democrat President seeking to curtail them.
