A coworker showed me this afternoon a photo of the rifle I found when I was magnet fishing. I made a thread about it :

The photo was used for commercial purpose, check :



www.dankoprotect.es...

I just sent them a message telling them about it. What should I expect or do now?

Tell them where to send your photo royalties. It will be taken down in no time.

On a lighter note, at least it's just a photo of a magnet.
I found out that someone I knew was using photos of one of my children in photo contest without my permission.
I completely lost it.

That all depends on what you want. If you don’t care about them using it for free, but would like to have your name attached to the photo, you could simply ask them to add your credit to the pic.
If you want them to pay you for the use of your property, you would need to send them a cease-and-desist order, which is best done through a lawyer. They will be given the chance to remove it and claim they didn’t know. If they remove it quickly, there will be little for you to argue about in court. However, if they have made a sizeable amount of money off of that ad, then you may be able to argue that some of that money( not much) is to be paid to you.

I intellectual property rights have to be defended in order for you to claim those property rights.

Thanks for all that info. I'm ok if they want to keep using the photo but it would be great to have some symbolic recognition.

If it were for non-commercial use then I would just ask them to add the photo credit. If they are using it to make money they can either take it down or pay me.

I would let them know that you have seen your photo and it made you proud yet you are curious how they got it.

Then, perhaps, they might want the story behind the photo because that's always good for a selling tool.

See if they at the least thank you and offer any freebies.

If they don't respond nicely then let them know you love their products.

If they offer nothing, then just be proud.

Great find - hope the gun wasn't used for nefarious purposes.

You got one of the best examples they could find. That other guy found a sword!

Never heard of magnet fishing. sounds fun.

Give them a description of how you found it and i bet they will send you something.

Or you can try to get the massive amount of royalties this company is making off your photo. just kidding.

I think ATS deserves part of the credit since it's here where I posted it. If they send me a magnet like the one advertised, I might post a video using it in my YT channel.

Your magnet and their magnet look similar. That is probably why they grabbed the picture. If you make a video using their magnet and you allow them to link it, you should get some free metal detecting equipment. Maybe you can make a deal instead of worrying about getting defensive.

I saw that photo when you posted . I remember thinking it was cool that you pulled that old bb gun out of a pond I think..cool
I would see what they say then tell them to send you a couple of their magnets and call it a day . Unless they continue to make money off of your work, then you should get something. Maybe when they get a new product they can send one to you for testing or something. Could be good for both sides.

I think there might be some kind of rule to that effect in the T&C. If you post something here, ATS owns it or part of it, or maybe they just have permission to use it anyway they want, I'm not exactly sure.

I hope you find a satisfactory agreement with these people. (the Europeans I mean)
