Clearly sessions was forced out and that makes whithaker ineligible for the position.

Wrong. DOJ = Executive Branch = Serves the President

The DOJ didn't always exist, along with ABC federal agencies (FBI, etc). They were created to assist the President in carrying out his duty of executing the laws created by Congress and defending the Constitution.

The only Constitutional Crisis is another branch of government (either legislative or judicial) attempting to infringe upon the separation of powers and meddle in the affairs of another branch of government.

The President can put whomever he wants in that position. Clearly Rosenstein was not qualified to assume it, considering his total and gross incompetence/negligence in allowing the criminal conspiracy against Trump to continue. The plug should be pulled immediately, and all involved should be terminated/have their clearances revoked until the anti-Americans are all out.

EXCEPT the actual law lil bush gave us states otherwise.

That is why i say either scotus or congress has to fix this before it gets out of hand.

It means he didn't want to resign and had to be asked. More than one way to skin a cat.

That is your OPINION.

Maybe Sessions wanted to quit for a long time and just couldn't find the right words?

Maybe the job he was hired to do had a prearranged end date?

Maybe he moved to far away from the office and had a long commute and didn't want to drive that far anymore?

You do not know the reasons so please stop acting like you do.

"At your request" is pretty easy to comprehend and doesn't apply in your examples. Is English your first language?

What i and sessions is saying is that he was fired! Do you know what a pink slip is? Do you know what trump is know for? It is one and the same.

Right. AG serves at the pleasure of the President, like every other cabinet Sec (AKA political appointee) along with every employee of the executive branch and the various executive branch agencies.

Agent = someone acting on behalf of another within a specific authorized scope.

Who's "agents" do you believe these people are? Why, agents of the President of the United States... of course. That's why FBI special agents for instance are appointed by the President, not merely hired off the street.

Point blank: Trump is allowed to fire Sessions or any other employee he is dissatisfied with. After all, every DOJ/FBI/etc employee is working under the President's Constitutional authority & duty to execute the laws of the Union and preserve/defend the Constitution. Their oath says as much.

It seems Americans are in dire need of civics lessons. Start with Separation of powers, appointments clause and then go on to read about the formation of the FBI and various other executive agencies.

Why are Democrats still worried about Whitaker? Even though he's now overseeing Mueller (instead of Rosenstein), Whitaker assured Dims Nadler and Cummings on Friday that he's not going to do anything illegal, regarding the Mueller probe.

It is not about politics left or right but the rule of law.

You already know this.

If they really want whithaker then vote him in legally.

Yes potus can fire them but by law when he replaces or appoints temps they have to go through or have the advise and consent process.

This keeps the public safe from tyrants attempting to obstruct justice.

Isn't it interesting how you guys only care about the rule of law when you think it will get you what you want, and even then you twist it?

maybe Trump knew he wanted to leave because of the long drive but was staying out of a fierce sense of loyalty? So Trump being the kind and compassionate leader of the free world let him off the hook.

Prove I'm wrong

Whitaker gets to stay in his position as "acting" for 213 days. The DOJ and a Federal Judge says his appointment is legal.

I don't want to hear it. The left blatantly, clearly, obviously and unmistakably is absolutely and unquestionably 100% disinterested in the so-called "Rule of law."

So much that it is a joke.

If you believed in 1/10th of the crap you're saying, you'd have joined the calls for the Mueller farce to be shut down without recourse.

Further, he was already investigated & cleared by the FBI and the agents involved admitted/confessed there was "no there, there"

Beyond all that, the severe and extreme misconduct by those individuals involved in both this lie/farce AND the Clinton investigation circus have completely destroyed any credibility they had remaining along with permanently giving them the label of "traitorous scum"

Any person still supporting this joke has precisely zero interest in the rule of law.

So again, save the ethical/moral high road fallacy for someone who hasn't been paying attention.

omg!

only if sessions resigned on his own free will

since he was forced out the position has to be filled through advise and consent so that potus does not appoint someone to cover up for him or someone who would fail to follow the law.

His resignation stated that it was requested. The very first line...
At your request I am submitting my resignation.

You really can't fight that.
