US policy is "two generations of punishment". We're working up to three, but it's hard to track down the immigrants parents.

One problem is that it's not actually legal, there's another law in place that says children can only be jailed for 20 days over immigration. If you're keeping family units together, then you're effectively saying anyone can only be jailed for 20 days which in turn brings back the catch and release program that Trump is trying to stop.

The other issue is that this does nothing to zero tolerance. We are still running around grabbing suspected illegals off the streets and putting them in concentration camps. It's still just as big a crime against humanity.

A concentration camp that has free medical care, free education, and free entertainment? Sign me up.

In germany we have a term for people with a such a behaviour, power-greedy being which play god till they notice that they run into headwinds and might lose their power. Then they do 180 degree turns, like Trump did now.

That is what they are. That is what the Japanese "internment" camps were in the US during WW2, we just wanted to sound morally superior so called them something different.

The camps were up and running in Germany for 10 years before they started killing people in them.

What everyone who only looks at the surface needs to understand is that there are sections in this EO that reference the whole reason that this is been happening, for the most part:

- Sect. 2(b)(iii) notes that "'Alien child' means any person not a citizen or national of the United States who has a legal parent-child relationship to an alien who entered the United States with the alien child at or between designated ports of entry and who was detained."


- Without documentation or some other form of proof, the US will not know if the "alien child" has an actual, legal parent-child relationship and should err on the side of caution that they may not

- Sect. 3(a) notes that "The Secretary of Homeland Security (Secretary), shall, to the extent permitted by law and subject to the availability of appropriations, maintain custody of alien families during the pendency of any criminal improper entry or immigration proceedings involving their members."


- This could dramatically increase the amount of time that children are in a detention facility. Granted, they will be with their family, which will be better for them in that regard, but as you will see in a few bullet point, Trump is looking to do away with the 20-day maximum agreed upon in the Flores-v-Reno ruling

- Sect. 3(b) notes that "The Secretary shall not, however, detain an alien family together when there is a concern that detention of an alien child with the child’s alien parent would pose a risk to the child’s welfare."


- So, who makes that determination, and under which metrics? Is it subjective? Will it be able to be used as a flippant way to punish some immigrants versus others? These are appropriate questions to ask.

- Sect. 3(e) notes that "The Attorney General shall promptly file a request with the U.S. District Court for the Central District of California to modify the Settlement Agreement in Flores v. Sessions, CV 85-4544 ('Flores settlement'), in a manner that would permit the Secretary, under present resource constraints, to detain alien families together throughout the pendency of criminal proceedings for improper entry or any removal or other immigration proceedings."


- If the big concern really is unnecessary detention of these individuals, wouldn't it seem like doing away with a mandatory maximum in which children can be held in these detention facilities fight against a just way of dealing with these children? Again, I understand that they would be with their families, but detention is still detention--it's a state of limbo with minimal freedoms

- There is also no guarantee that the Central District Court of California will amend or remit that portion of the agreement, and if not, that really pisses all over this EO, dontchathink?

Anyhoo, without a real in-depth reading of this EO other than those notes, this appears to be something that could alter the way that these kids are being separated in very miniscule ways. Like I noted, the lack of legal documentation showing familial connections is a big problem, and I think that will be the main issue that keeps many of these families separated, even with the new EO.

We'll see.
