So here is an inersting tidbit, as an extension of the discussion from yesterday about the Reveal article Alyssa Milano and Rosanna Arquette were braying about on Twot.

My post

The case sited by reveal is a current case, Jennny Lissette Flores, et al. v Jefferon B Sessions, et al., which is interesting, because it is very similar to another case from 1997, Flores v. Reno. Hmmmm. There couldn't be more than one Flores in the US, could there. Well, I guess there are, but in this case, it's the same Flores, 21 years after the fact.

Well how about that. Reno v. Flores was settled in 1997, appealed to the US 9th district court, then brought before the Supreme Court as Reno v. Flores, 507 U.S. 292 (1993), ruling against the claim made by Flores. In the opinion of the court:


On March 23, 1993, the Supreme Court announced judgment in favor of the government, voting 7-2 to reverse the lower court.[9] Justice Antonin Scalia, joined by Chief Justice William Rehnquist, and Justices Byron White, Sandra Day O'Connor, Anthony Kennedy, David Souter, and Clarence Thomas, held that the unaccompanied alien children had no constitutional right to be released to someone other than a close relative, nor to automatic review by an immigration judge.


There is more on the wiki page and it gets sort of deep. But the ruling also says that they can't be released to an incarcerated relative.

Why does this matter? Becasuse yesterday, POTUS signed and EO that says that children will not be separated from the parent or guardian during detention. That might be a problem.

As I mentioned in a previous post, there is an heirarchy of law that goes like this:

1. The Constitution (Supremem Law)
2. Case Law (establishes and interprets law passed by congress as constitutional and how it can be applied).
3. Laws passed by congress and signed by POTUS.

The Reno v Flores decision by SCOTUS is Case law. It is for all intents and purpose, set in stone. Today we got an article from Vox

Flores agreement: Trump’s executive order to end family separation might run afoul of a 1997 court ruling

And they are right. The Trump legal team had to know when the EO was signed that it carried no weight because of established case law. The SC ruling and subsequent laws passed within the boundaries of that law make it easy to challenge the legality of the EO in court.

It looks like Trump effectively put out the media fire on this issue, while simultaneously allowing it to be forced back into the hands of congress at a future date.

CNN, MSNBC, ABC, CBS, Fox all aired non-stop coverage of the on-going ANTIFA riots whenever they occur then they all follow-up with OP EDs in their respective talking heads shows. It's made for TV drama ripe for viewer eyeballs (= ADVERTI$$$ING) so when you make the statement "when media coverage of resistance protests has been actually very low" you are either ignorant or never watch MSM news outlets.

They all live for that stuff.
