It will have to go to arbitration per the terms of the NDA, before it ever goes to court.
You really should actually READ THE AGREEMENT. The terms are very specific including how disputes are handled.

If one party feels that the other party is violating a contract the only remedy is the courts. In a contract a judge can enforce the terms of the contract. Or, a party can seek the courts to render a judgement on all or parts of a contract. Happens all the time.
The courts decide when the parties cannot agree on what the contract means, or if it is even a legal, valid contract.
I suspect that Stormy's law team found an error in the contract that makes it null, and nonbinding.
The courts will decide, unless there is an out of court settlement.
Simple.
