A federal judge tossed a lawsuit against Hillary Clinton by the parents of two Americans killed at a diplomatic compound in Benghazi, Libya, ruling Friday the former secretary of state did not defame them when disputing allegations that she had lied.

"The untimely death of plaintiffs' sons is tragic, and the Court does not mean to minimize the unspeakable loss that plaintiffs have suffered in any way," U.S. District Judge Amy Berman Jackson in Washington wrote in a 29-page opinion.

The suit also alleged Clinton’s use of a private email server caused the death of their sons, Sean Smith and Tyrone Woods, because it exposed terrorists to sensitive information. They claimed Clinton lied when she allegedly told them it was a YouTube video that prompted the consulate attack.

Berman ruled the parents didn't sufficiently challenge that Clinton was not acting in her official capacity when she used the private server, and that the families didn't put forward appropriate claims that Clinton defamed them or put them in a false light.

Hillary dodges another lawsuit, she did not defame the parents of victims of the Benghazi mess when she disputed the accusations. Also Hillary was not acting in her "official" capacity when she used her private server, so this was also insufficient to be a viable lawsuit against Hillary.

Sorry, there was classified info on the server and Hillary skates/skated? Also if Hillary kept the server in the basement of her home, unsecured, is this how an "acting official" handles this very expensive classified info?

I may be reading this wrong, but actually I think this quote says more than people are giving the judge credit for. Seems to me the judge is saying you just worded your claims wrong. Reword it and come back and I'll be able to do something about it. I think the two keywords in that quote are "sufficiently" and "appropriate."

If the judge was appointed by bill Clinton, wouldn't that be a Considered conflict of interest ? ..the judge should have recused herself and let someone else handle it.

Don't tell me... we're looking at another "so called" judge. At least this one isn't going to be partially responsible for the next U.S. terrorist attack, if the attacker arrives from one of the 7 nations that other so-called judges wouldn't curtail travel from.

They claimed she told them "X" in a large group of Benghazi family members, but every one else there said they were lying..

She use the rule of opinion in favor of Hillary and distanced herself of the fact that she was acting on May 20 like she was siding with judicial watch on the E-mail scandal.

What IF the lawyers filing the suit were "bought off" ahead of time to create an "automatic controlled confirmation" that the whole Benghazi thing wasn't Obama's/Hillary's fault.

Maybe, but from what I have read the Benghazi thing was a messy goat screw that could have been responded to and perhaps with little to no loss of life.
For some reason the response team stood down.
