Now this is a very hard subject for many including myself as my sister is a victim of rape. I have to ask the question though, because it has been on my mind lately considering certain court cases, the question goes like this. If the girl is to drunk to consent than the man is a rapist, but what if the man is too drunk to consent, then is it still rape? and if so why or why not?

Society still has an issue with accepting men can be raped. I'm talking justice by the way not people in the street. Yes most will give the standard "You sure?" sort of response when you tell them your a victim but will eventually understand but try to explain to a lawyer, a police officer etc. that you are a male rape victim trust me it doesn't go the way you think.

Yes, consent is consent period, being inebriated vs being blackout drunk however, is a more important issue though

When both parties have been drinking heavily, I don't see how, after the fact one can accuse the other or rape.

Large doses of alcohol seem to loosen inhibitions and also lead to poor decisions for all people.

Men and boys are raped. They are usually (although certainly not always) raped by other men though. When people (usually men and usually MRA's or MRA sympathizers) bring up this "argument" they tend to leave that bit out because it furthers the Men Are The True Victims narrative they are invested in more by implying that women are raping men with no accountability with that teensy omission.

I think that when both the male and the female are intoxicated they should be accountable equally; so while alcohol is a mitigating factor, it should not define accountability by gender. That's illogical and unfair. Ostensibly, the "logic" behind the idea that an intoxicated male is responsible and an intoxicated female is not is because the male is larger and in theory able to overpower the female, so he has more responsibility. I don't necessarily agree with that, I think too much burden is placed upon the male in many of these circumstances.

If one heavily drinking person says no, clearly and loudly, and is fighting off the other really drunk person, it's rape.

If they (both) were willing at the time, it's not rape.
If a passed out person, is sexually handled, it's rape.

Rape generally requries penetration by force and without consent.

Here, a woman taking advantage of a man without consent would be classified as First Degree Sexual Offense, and is the same level of felony charge as First Degree Rape. It's just a different charge that doesn't require forced, non-consensual penetration.

Check how your state defines the actual acts.

I agree and that's why I didn't say when men are raped by women. Even when a guy is raped by another guy they are often ignored because the idea that a man can be raped is still seen as strange or confusing for those who don't understand how the body works.

What causes you to believe that? This is a man that sees sexual assault as a joke and laughing matter.

To the OP:

Yes it is rape. However society generally doesn't view it as rape due to a double standard.

Absolutely true. I also think there is an added charge because sex for men often contains an element of dominance, so being penetrated by another male without permission has another layer that society gets squirmy about; so they tend to ignore it, it's just too much for most people. If a woman rapes a man it is considered not as a bad, like the man or boy should just feel "lucky". So these men and boys just have no voice at all, it's just so wrong.

This causes more long term issues than you can imagine. I go to court with a family every time this one rapist comes up for parole. If Im on "mental health rotation" or not.. I get a call and I go.. and have for several years. It is terrible for the victim, but its long reaching for the child. This case was wonky and he wasnt convicted of rape for this victim, but he IS in prison for aggravated rape of a person who was with this victim. In any case, the laws in Il have changed.. and for the better IMO.

Rape is rape as far as Im concerned. However, women and men both need to be responsible and not put themselves in a position to BE raped.. overly intoxicated, etc. Ive seen attys argue that 2 drinks only and the woman consented.. when she was so drunk she was passed out in a yard and no way she could consent. Conversely Ive seen women cry rape when there was clear consent and it was a matter of not wanting to get caught sleeping with a particular person. There is a reason why men AND women dont come forward when they are raped though... the most personal things come out in court.. and past behavior, pictures off of facebook, and sometimes blatant lies are thrown out for everyone to see.

well then...let's make rape legal, after all, both parties lie. that way there won't be any of that nasty "he, said, she said" trials....all women will need to be escorted by a family member, they must cover themselves at all times so that other men don't get excited enough to rape them. if they go out without a male member of the family, they can be beaten by their father or husband....
