Yeah I don't know why I missed the initials NI in my source searching.

Hate crime it is. If it is in fact a hate crime.

In terms of discrimination from www.equalityhumanrights.com....

"The Equality Act 2010 says you must not be discriminated against because of your race.

In the Equality Act race can mean your colour, or your nationality (including your citizenship). It can also mean your ethnic or national origins, which may not be the same as your current nationality. For example, you may have Chinese national origins and be living in Britain with a British passport.

Race also covers ethnic and racial groups. This means a group of people who all share the same protected characteristic of ethnicity or race.

A racial group can be made up of two or more distinct racial groups, for example black Britons, British Asians, British Sikhs, British Jews, Romany Gypsies and Irish Travellers.

You may be discriminated against because of one or more aspects of your race, for example people born in Britain to Jamaican parents could be discriminated against because they are British citizens, or because of their Jamaican national origins."

For racial abuse

"In England, Wales, and Scotland, the Public Order Act 1986 prohibits, by its Part 3, expressions of racial hatred, which is defined as hatred against a group of persons by reason of the group's colour, race, nationality (including citizenship) or ethnic or national origins. Section 18 of the Act says:

A person who uses threatening, abusive or insulting words or behaviour, or displays any written material which is threatening, abusive or insulting, is guilty of an offence if—

(a) he intends thereby to stir up racial hatred, or
(b) having regard to all the circumstances racial hatred is likely to be stirred up thereby."

Because that is not how law works.

Law is based not purely on the statute, but on how a prosecutor can use that statute to win landmark cases which change the way the wording is interpreted for all time.

Race is an umbrella term and covers ethnicity including Nationality.

As to the ridiculous notion of fat people being Targetted, skinny people aren't protected either.
So it isn't discriminatory in the slightest.

We could speculate on the why nots all day.
Until precedent is set it remains not a hate crime.

Yep, just checked www.legislation.gov.uk... I WAS WRONG and you done me on the nationality so...

...fat people can still be abused without being included under hate crime laws though, so long as their obesity is not their disability of course.

Oh I understand that, and I was wrong about the nationality aspect as Septic Scot pointed out.
But the CPS getting a conviction for an emo being abused is unlikely to be included through case law while the 5 specific groupings are prescribed as they are.

Just as hateful in my opinion yet the law protects a few specific groups.

I suppose the other side is that if the law isn't specific on groups it is open to abuse.
Should neo nazis be protected from employment discrimination based on their political belief's? Or Morris dancers be protected from outright and well deserved mockery.

Hate crime was not established by precedent, it was an act of Parliament.
So is it more hateful to abuse a religious person than a fat or skinny person then?
I think the hate is the same.

But they are still dead. Killing someone is killing someone whether you do it because they are gay, straight, white, black or because you do not like the shirt they are wearing.

Agreed. And the person committing a single homicide, and the person committing hate crimes would both be punished. But you see, there is something slightly more sinister about a hate crime. To me, anyway.

There have been people who killed their children because they didnt do as their parents told them to do. In other cases black/white /asians etc killed each other because of their race. The hate crime is the more sinister?

Murder=murder=murder=murder.

Btw , you want to see hate crimes? turn your eye to south africa right now. Entire white families are being butchered for being white.

"Found on childrens playground"

Muslim....not alarming
Immam.....screams radical.
Conclusion....probably caught trying to rape kids because he didn't "get any sex" for a long time and that's what radical beliefs allow. That leads to bumps on the head.

That's a very far stretched opinion. Can't tarnish all people for the actions of a few.

At the moment on UK news it just mentioned that it could have been a racial attack!

Yeah Duh, im sorry but that is the first thing they want to sell to you since a long time now already. Before the facts are in with a crime on a muslims "it is a hate crime".

When a 7 year old gets raped by a refugee "we need to investigate it and make sure the child is not lying"

Please...

Honestly I havent read every respose but I will answer. Regardless of it was a white guy or sunni or shia or fricking disneyworld employee that killed him.

The world is getting sick and tired of muslim terrorist attacks.

Blowing up markets, attacking school kids.

The Muslim world has a huge problem.

Don't blame me for not trusting you when they were making suicide vests in an apt bldg. You ok putting your kids to bed over an apt rented to muslims?

Perhaps you're purposely being a tad slow today!!

I employ a "Employement Law Firm" so I guess they know what they are doing, perhaps you missed that in my post????

I am fully aware of the law, what I said if you wish to take another gander at my post was "People in protected groups when up against the wall, will play the "Race Card", Gay Card" etc etc, nothing to do with the law and the reason it was written, people abuse the system to their own ends!

If you really believe that this does not happen in the UK, then you are living under a rock!!

You've just summed it up there. They don't have any special protection under the law. The existing protection that is afforded to everyone has been abused by selective groups to the point where employers are possibly overly wary about them now and don't want to have to spend the time, effort or money having to defend themselves in court against a claim. The end result is that you need to jump through more hopes to show there is no case, rather than there being any extra protection.

If your company took a different stance and were happy to take each case to court if it so proceeded it'd be shown there is no extra protection.

Group of muslims kill man because he's non muslim - murder.
Non muslim kills a muslim - hate crime.

Muslims screams "kill all non muslims" - freedom of speech
"Islam is intolerant" - hate speech

Burn a bible in the street - disrespectful
Burn a quran - inciting hate

Thanks liberals.

Do you really think the death of one Imman is going to cause anything? I think not, I think you may be sensationalising the story when there's no need to. If all the terrorist attacks on the UK have not caused problems with the UK populace, I doubt very much the death of one man will either!!

Rodney King!... and he wasn't even killed... do I really need to say more?
