Lawyers for Boston Marathon bomber Dzhokhar Tsarnaev filed a motion for a new trial Monday, less than two weeks after he was formally sentenced to death for the 2013 attack.

The motion did not contain any details on Tsarnaev's legal arguments, saying only that a new trial is "required in the interests of justice."

Tsarnaev's lawyers call the motion a "placeholder" until they can file a more detailed motion next month.

Did a search and came up with nothing hope this is new to the world of ATS.

But what do you all think? What's he trying to accomplish here?

I AM NOT TRYING TO START A DEBATE ON THE BOSTON BOMBING!!!! This has been talked about numerous times.

I am trying to talk about why this guy would allow his lawyers to admit his guilt then ask for a retrial??? What do you beautiful ATS people think?

not only his lawyer, he said himself during sentencing that he did it.
i can't see anything that could make a difference, especially with all the video showing him walking up with a back pack and then leaving without one right where the bomb went off.

This whole thing has been fishy from the start .

From my experience with years of research on resistance groups or "jihad" groups . I can tell you with certainty that if these brothers did comit this act , it was a rogue act without a doubt.

I recall reading a news peice from a news outlet that most Chechen resistance groups use as a hub ,right after the bombings .

The Ameir (leader ) of the kavaz Emirates came out and said that "these two had no connection to us , our war is here , not in the US" .

He stated this after the FBI claimed these boyz received training and orders in Chechnya.

Shortly after that news post by the website in question ,the website was shut down .

Like I stated before I have studied these groups and one thing is certain if they do an Attack they always take responsibility for the attack .

No group in Chechnya to this day has claimed responsibility for the Boston bombings .

My honest opinion is that ,like the first world trade center bombing that got bin Laden on the map,the Boston bombings put Chechnya on the map for a possible future event .

Also note that most jihadist don't just bomb and run, they most often try to martyr. This is part of their flawed khuaraij Ideology .

This whole thing is strange to me .

Very strange .

That is not what the FBI claimed.

And regardless the Attack was so Unorthodox .

Keep in mind most attacked come with a reason , What was the reason for the attacks ?

What has the US done to Chechnya ?

Interesting, asking for a new trial is different than the automatic appeal that comes with a death sentence. There might be an interesting twist in the case, it would have to be good to overcome his supposed confession at sentencing and his lawyer admitting her clients guilt in opening remarks.

The appeal has to be based on some error committed during the trial that affected the defendant. I am curious what they are going to claim what was in error.

Maybe an issue with the jury pool being picked from the city it occurred in. The unable to get a fair trial / due process argument.

I would grant an appeal unless he waived his right to council after pleading not guilty. His attorney has no experience in anything but sentencing.

The trial reached a verdict and sentence so a mistrial would be impossible. It has to occur before the end of a trial and must be based on something that is so prejudicial to the defendant that it would unfairly affect the proceedings and outcome.

His confession though... That's the part confusing me. If we go down the road you suggest it might be an appeal based on inadequate council.

My prediction is that he will have his sentence overturned and be granted life without parole.


Maybe the Feds have a soft heart for their Patsy ...... Meh maybe not

Yeah, I realized I mistyped when I said mistrial and edited. Sorry for the ninja edit.

If I were judge he would have to either get new council or waive his right to council after trying to plead not guilty. Failing that, I surely grant an appeal.

What happened to him being throat damaged and unable/unlikely to speak again?

No worries it happens..

To grant new council the request would need to come from the defendant himself and to my knowledge he never made the request. I know defense council can asked to be removed from the case but they usually have to have a damn good reason for the request to have it granted.

Even when defendants refuse council to represent themselves judges have still assigned defense council to monitor.

As for whether or not the defendant could talk is pretty much a moot point since he is not required to take the stand at all. His refusal to take the stand cannot be used against him either.

An appeal would have to come from the next higher level court and not by the trial judge. He is pretty much limited to the immediate trial and outcome.

Oh come on now. Someone needs to strap a pressure cooker bomb to his back and them turn him lose in the prison yard. Then, detonate the bomb. Eye for an eye and problem solved.

Pieces of crap like this deserve nothing but vengeance from us.

They should bring to the trial the pictures of the many secret service men scattered about the premises in the same beige outfits engaging in various sorts of activity. And the make-up kits scattered about the scene, with the use of fake blood and various inexplicable activities.

... not gonna happen.

The FBI weakly tried to make them out to be foreign or Muslim terrorists, something that didn't pan out in court... everything about Dzokhar screams American and he apparently didn't take his religion very seriously at all. Tamerlan on the other hand was bi-polar which was exacerbated by his abusive father. Neither were involved in any extremist group though Tamerlan admired Al-Qaeda. Products of a dysfunctional family.
