Judge slams victims for tot's 'black men' fear

I really believe that judges have way too much power anyway. They have absolute control over the fate of anyone that crosses their path... regardless of innocent or guilty. It could even be something trivial, and a judge can ruin a life.

That kind of power needs to be put back into the hands of jurors. A judge should have no more power than that of a sports referee.

more divide and conquer race baiting from the news. and the bench.

We have thousands in jail for smoking pot yet these scumbags admit to an armed home invasion and get probation because a 3 YEAR OLD is afraid of the people who broke in HER LIVING ROOM>

Good is evil, black is white, up is down. Our society makes no sense anymore, unless you look at it upside down and backwards.

This judge is total scum. Also. Don't they have mandatory minimums for violent felonies like armed robbery? This charge is basically one step down from murder. I'd have to look that up for which state this was in. Either way this guy should no longer be a judge, but then that would be "racist" also if he were disbarred.

No, it sounds outrageous because it is BS, if you read the linked article, the parents wrote a statement essentially blaming robbers for causing fear of black men:

Jordan wrote in a victim impact statement that her daughter was still "in constant fear of black men." Both robbers were African-American.

Of the sentence:

Wallace and his accomplice, Marquis McAfee, both 27, were arrested about three weeks after the robbery. Both pleaded guilty and McAfee, who was on probation for a prior crime, was sentenced to 10 years in prison, which he is serving.

But Stevens said in court that Wallace had no prior convictions for violent crimes and strong support from his family and friends, who wrote letters to the judge noting that he had won the "Johnny Unitas Scholar Athlete Award" at Iroquois High School and stayed out of trouble during 17 months in jail awaiting trial.

Stevens said in court that "more times than not" he sends offenders who use firearms during their offenses to prison, but in this case "I think the equities weigh in favor of you having the opportunity to redeem yourself."

Further, if you read you will see that the sentence of probation clearly was already considered prior to this Victim Impact Statement:

I don't have a recommended sentence but I feel like probation is not enough. This crime will effect my daughter for the rest of her life and Mr. Wallace deserves to serve time. If holding a little girl at gunpoint gets you probation, then our system is flawed.

As the father clearly mentions it, twice, then they obviously knew that probation was being considered. They wrote this statement to get something beyond probation. Ergo, the statement didn't incite the judge to give probation.

As the thread is clearly based on false premises, I'll be reporting it.

Pretty sure that if you were an impressionable three year old, you'd be scared of whatever waltzed into your home and terrorized you. It's not outrageous for a child to be scared of something that violated what is supposed to be a safe environment.

The thread isn't based on a false premise. The judge, while not coming out and saying it directly, did imply child's fear and the parent's fostering of that fear, was racist. Screw that judge. He's garbage who doesn't deserve to preside over anything.

On a side note... Probation!? Really!!? It's a shame someone in the family wasn't armed.

This poor little girl is 100% justified and acting on a very well-trained instinct which will serve her safety well.

Anyone wanting to argue with that should first provide a list of white parts of towns/cities that a black person cannot safely walk at 11pm.

I wonder what his record of being a judge is like, if stuff like this has happened before. Really, I can see how the girl could be traumatized. I really don't think it was the time or place to stop the court proceedings and point out the girl's fear and call her racist. It's ridiculous. Then, he says it won't affect his decision. Just giving them probation and basically turning them back out on the street after his little speech of being offended, it looks to me that he did.

Read my post, read what the judge actually said. Or listen to the video, I don't care. The judge never accused the little girl of racism. Period, full stop, this thread's very title is based on a lie. This thread's OP then goes on to claim that the robbers were sentenced to probation - that is factually untrue.

One robber was sentenced to 10 years in a different hearing, as he had prior run-ins with the law. This hearing was for a robber who was otherwise completely clean and had a strong support network. Again, the victim statement itself was written with the knowledge that the judge was considering probation. Therefore, the victim statement had no impact and the judge sentenced the robber to what he was already considering: probation.

What he criticized was the victim statement - specifically the mother's. If you listened to him, you might have heard this:

"I am offended. … I am deeply offended that they would be victimized by an individual and express some kind of fear of all black men," he said.
...
"I wonder if the perpetrator had been white would they be in fear of white men. The answer would probably be no."

That is why he takes offense to the victim statement - because the mother alleges:

"Whenever we are running errands, if we come across a black male, she holds me tight and begs me to leave," the mother said. "It has affected her friendships at school and our relationships with African-American friends."

It's the gross generalization that he has a problem with:
